Description:
The contract involves delivering and implementing a mobile system for detecting and neutralizing Unmanned Aerial Vehicles, along with specific warranty conditions and access protocols for confidential information.

DESCRIPTION:
1. The subject of the contract includes the delivery and implementation of a mobile system for the detection and neutralization of Unmanned Aerial Vehicles (UAVs).
2. A detailed description of the subject of the contract regarding the base vehicle constitutes Appendix No. 2 to the SWZ.
3. A detailed description of the subject of the contract regarding the installation and the system for the detection and neutralization of Unmanned Aerial Vehicles (UAVs) constitutes Appendix No. 3 to the SWZ.
4. Warranty conditions:
4.1. The minimum required warranty period for mechanical, electrical, and electronic components of the vehicle on which the installation was made is 24 months with no mileage limit.
4.2. The minimum required warranty period for the vehicle’s paint coating, on which the installation was made, is 24 months.
4.3. The required warranty period for perforation of the vehicle's body elements, on which the installation was made, is 72 months.
4.4. The minimum required warranty period for the installation and equipment, including the detection and neutralization system for Unmanned Aerial Vehicles (UAVs), is 24 months.
4.5. The warranty period will start from the date of acceptance of the subject of the contract.
4.6. Updates for the Command and Control software (hereinafter: "C2 Software") must occur no less than once every quarter.
INFORMATION ON RESTRICTED ACCESS TO PART OF THE SWZ:
1. Based on Article 133 para. 3 in conjunction with Article 18 para. 2 of the Public Procurement Law (Pzp), the contracting authority restricts access to Appendices No. 3 and No. 4 to the SWZ, due to the need to protect confidential information contained therein.
2. Access to Appendices No. 3 and No. 4 to the SWZ will be provided according to the following rules:
2.1. In order to gain access to Appendices No. 3 and No. 4 to the SWZ, the contractor will be required to submit a request according to the form that constitutes Appendix No. 8 to the SWZ.
2.2. The request must be signed with a qualified electronic signature of the person(s) authorized to represent the contractor.
2.3. The request must be accompanied by a document evidencing authorization to represent the contractor (e.g., current extract from the KRS, power of attorney). Regarding the form of documents confirming the representation, the principles resulting from the Regulation of the Prime Minister of December 30, 2020, on the manner of preparing and transmitting information and technical requirements for electronic documents and electronic communication means in public procurement processes or competitions should apply.
2.4. The request must include a confidentiality agreement signed by the person(s) authorized to represent the contractor according to Appendix No. 9 to the SWZ.
2.5. If the request is incomplete or contains errors, the contracting authority will call on the contractor to complete it within 3 days from the date of sending the request. Failure to complete or incorrectly completing the request will result in it being left unprocessed.
2.6. The request must be sent to the email address: a.tarka@um.sosnowiec.pl
2.7. Access to Appendices No. 3 and No. 4 to the SWZ will occur at the email address specified in the request. The contracting authority will send a password-protected file containing Appendices No. 3 and No. 4 to the SWZ. However, the password enabling access to Appendices No. 3 and No. 4 to the SWZ will be sent by the contracting authority via SMS to the mobile phone number provided in the request.
2.8. The contracting authority will not make Appendices No. 3 and No. 4 to SWZ available to a contractor who has a disqualification basis described in Chapter I, para. 18 of SWZ.
ORDERS REFERRED TO IN ARTICLE 214 PARA. 1 ITEM 8) OF THE PZP ACT:
The contracting authority does not anticipate awarding contracts based on Article 214 para. 1 item. 8) of the Public Procurement Law.
DEADLINE FOR EXECUTING THE ORDER:
The deadline for executing the subject of the contract is 8 months from the date of signing the contract.
The contractor will grant an unlimited non-exclusive license for the C2 Software.
PROTECTION OF PERSONAL DATA COLLECTED BY THE CONTRACTING AUTHORITY DURING THE PROCEDURE:
Information on the protection of personal data is included in Chapter I, para. 17 of the Terms of Reference [hereinafter: SWZ].
GROUNDS FOR EXCLUSION:
1. Only contractors not subject to exclusion may apply for the contract.
2. The contracting authority will exclude contractors from the proceedings who fall under the exclusion criteria mentioned:
- in Article 108 para. 1 of the Pzp act,
- in Article 7 para. 1 of the Act of April 13, 2022, on special solutions for countering aggression against Ukraine and for the protection of national security,
- in Article 5k of Council Regulation (EU) No. 833/2014 of July 31, 2014, concerning restrictive measures in relation to actions by Russia destabilizing the situation in Ukraine (EU Journal No. L 229 of 31.7.2014, p. 1), hereinafter: Regulation 833/2014, as amended by Regulation (EU) 2025/2033 on the amendment of Regulation (EU) No. 833/2014 concerning restrictive measures related to actions by Russia destabilizing the situation in Ukraine (EU Journal No. L 111 of 8.4.2022, p. 1).
3. Exclusion occurs for the duration of the circumstances specified in Chapter III, para. 2.3. of the SWZ.
4. In the case of a contractor excluded on grounds specified in Chapter III, para. 2.3. - 2.4. of the SWZ, the contracting authority will reject the offer of such a contractor.
5. A person or entity subject to exclusion on grounds specified in Chapter III, para. 2.3. of the SWZ, which applies for a public procurement or participates in a public procurement process or competition during that period, is subject to a monetary penalty.

CONDITIONS FOR PARTICIPATION IN THE PROCEEDING:
1. Only contractors who:
1.1. are not subject to exclusion,
1.2. meet the conditions for participation in the proceeding, if such have been specified, may apply for the contract.
2. Based on Article 112 of the Pzp act, the contracting authority specifies the conditions for participation in the proceeding concerning:
2.1. the capability to operate in commerce – the contracting authority does not set a condition for participation in this regard;
2.2. the authorizations to conduct specific business or professional activities, if required by separate regulations - the contracting authority does not set a condition for participation in this regard;
2.3. economic or financial situation – the contracting authority will consider that a contractor meets the condition regarding economic situation if the contractor demonstrates that they possess:
2.3.1. financial resources or credit capacity in the amount of at least PLN 2,500,000.00 (in words: two million five hundred thousand zlotys);
2.3.2. appropriate civil liability insurance in the amount of at least: PLN 2,500,000.00 (in words: two million five hundred thousand zlotys). In the case of contractors applying jointly for the contract, the condition regarding economic situation described in item 1.2.3. may be met jointly by all contractors. However, each of the conditions described in items 1.2.3.1. and 1.2.3.2. must be fully met by at least one of the contractors jointly applying for the contract. The contracting authority does not allow for the summation, division of amounts between contractors jointly applying for the contract regarding the condition described in items 1.2.3.1. and 1.2.3.2.
2.4. technical or professional capability – the contracting authority will consider that a contractor meets the condition regarding technical or professional capability if the contractor demonstrates that they have duly performed, in the last five years, a delivery worth at least PLN 2,500,000.00 gross involving the implementation of a system for the detection and non-kinetic neutralization of Unmanned Aerial Vehicles (UAVs).
INFORMATION ON THE SUBJECTIVE EVIDENCE:
1. The contracting authority requires that the contractor submit the following subjective evidence along with the offer:
− Technical specification of the offered subject of the contract prepared according to the template that constitutes Appendix No. 4 to the SWZ.
2. The contracting authority anticipates supplementing the subjective evidence if the contractor has not submitted them or the submitted subjective evidence is incomplete.
CLARIFICATION TO FIELD BT-536-Lot:
The indicated date in this field - 20.01.2025 is entirely indicative, while the deadline for executing the order is 8 months from the date of signing the contract. The contractor will grant an unlimited non-exclusive license for the C2 Software.
