The contracting authority anticipates the use of the so-called reverse procedure, referred to in Article 139, paragraph 1 of the Public Procurement Law, that is, the contracting authority will first examine and evaluate the offers, and then qualify the contractor whose offer received the highest rating, in terms of the absence of grounds for exclusion and fulfilling the conditions for participation in the proceedings. The contracting authority does not foresee the possibility and does not require the submission of an offer after conducting a site visit or verifying documents. The contracting authority does not stipulate the obligation for the contractor to personally perform key parts of the order. Pursuant to Article 118 of the Public Procurement Law, the contracting authority does not foresee the admissibility of using the resources of a third party. Contractors who meet the conditions regarding the rights to conduct a specific business or professional activity, as long as it follows from separate provisions, may apply for the award of the contract. Contractors who have the rights to conduct business in the field of trading in electricity may apply for the award of the contract - this applies to both parts of the order. The contractor, to confirm compliance with the conditions for participation in the proceedings, is obliged to submit the JEDZ in accordance with the instructions mentioned in Chapter XV of this SWZ. The JEDZ must be submitted electronically under the pain of invalidity, and the file must be affixed with a qualified electronic signature. 8. At the contracting authority's request to confirm compliance with the conditions for participation in the proceedings, the contractor whose offer will be rated the highest will be obliged to submit, within a specified period of not less than 10 days, the following subjective means of evidence - a current business license for trading in electricity issued by the President of the Energy Regulatory Office as of the date of submission. The contracting authority does not call for the submission of the aforementioned subjective means of evidence - the license, if it can obtain it from free and publicly available databases, especially public registers within the meaning of the Act of February 17, 2005 on the informatization of entities performing public tasks, provided that the contractor indicated in the offer form data enabling access to these means. The contracting authority does not stipulate the obligation for individual contractors jointly applying for the award of the contract to perform key tasks of the subject of the contract themselves. The condition regarding the rights to conduct a specific business or professional activity will be deemed fulfilled if at least one of the joint contractors applying for the award of the contract possesses the rights to conduct the business or professional activity mentioned in Chapter VII, section 2 point 2) of this SWZ and carries out the supplies or services for which these rights are required. Contractors jointly applying for the award of the contract must appoint a proxy to represent them in the procurement procedure or to represent them in the proceedings and conclude the agreement. The OFFER must include the relevant power of attorney in electronic form signed by the person or persons authorized to make declarations of intent for each of the contractors jointly applying for the award of the contract. 8. According to Article 117, paragraph 4 of the Public Procurement Law, contractors jointly applying for the contract must attach a statement to the offer, indicating which services will be performed by each contractor. The template of the statement is included in the Annex to the SWZ. The statement is submitted in electronic form with a qualified electronic signature by the contractor or as a digital representation of a document that has been drawn up in paper form and affixed with a handwritten signature confirming the compliance of the digital representation with the paper document; the digital representation of the document (electronic copy of the document that has been drawn up in paper form and affixed with a handwritten signature) is affixed with a qualified electronic signature by the contractor or by a notary.
