1. The subject of the order is the design, construction, and commissioning of a photovoltaic installation with a capacity of up to 500 kW along with connection to the power grid and obtaining the formal-legal documentation required by applicable law necessary for the commissioning and operation of the installation in question. The installation will be located in Miasteczko Śląskie, at Woźnicka Street 99, on plot no. 1894/2, Precinct Żyglin, owned by the State Treasury, under perpetual usufruct of the Ordering Party.
2. A detailed description of the subject of the order is included in Attachment No. 7 to the SWZ – Functional and Utility Program.
3. The order is divided into a design part and an execution part, and the conditions for carrying out the order are regulated in detail in Attachment No. 8 to the SWZ - draft provisions of the contract.
4. The task is co-financed under the program: European Funds for Silesia 2021 - 2027 Priority FESL.10 “European Funds for Transformation” Action FESL.10.6 “Development of distributed energy based on renewable energy sources.”
5. In cases where the Ordering Party refers to standards, technical assessments, technical specifications, and technical reference systems as mentioned in Article 101 section 1 point 2 and section 3 of the Act, the Ordering Party informs that equivalent solutions described in any such standard, European technical assessment, approval, technical specification, or technical reference system are allowed.
6. Employment requirements based on an employment contract – according to Article 95 of the Act: The Ordering Party requires that the Contractor, subcontractor, or further subcontractor employs physical workers for general construction tasks necessary for the realization of the order: earthworks, installation of photovoltaic systems, and management and arrangement of the construction site.
7. The control of the contractor's compliance with the requirements related to the employment of these persons and sanctions for non-fulfillment of these requirements are detailed in paragraph 4 of the draft provisions of the contract – Attachment No. 8 to the SWZ.
8. Information regarding site visits:
8.1. The site visit is not mandatory, which means that failure to carry out the visit is not grounds for rejecting the offer.
8.2. Rules for conducting the site visit:
8.2.1. The site visit will take place at a date specified by the Ordering Party and will be held at the location where the order is to be carried out, which is the subject of this procedure.
8.2.2. Interested Contractors must submit a request for the appointment of a site visit date and a confidentiality statement (Attachment No. 5 to the SWZ) in electronic form, signed with a qualified electronic signature according to the representation or the granted power of attorney, through the Platform.
8.2.3. The application must be submitted no later than November 10, 2025. The date of receipt by the Ordering Party is decisive. The Ordering Party reserves the right to change the aforementioned deadline by extending it.
8.2.4. In response to the request referred to in point 8.2.2 above, the Ordering Party will inform Contractors of the date of the site visit. Site visit requests submitted after the deadline specified in point 8.2.3. above will be left untreated by the Ordering Party.
8.2.5. During the site visit, additional information will not be provided, nor will answers to questions posed by Contractors be given. Any inquiries should be submitted in accordance with Article 135 of the Act, under the rules specified in Chapter XVII of the SWZ via the Platform.
8.2.6. The person designated by the Ordering Party to assist Contractors during the site visit will inform about cases where a ban on photography and recording sound and image may apply.
8.2.7. Information gathered during the visit regarding the Ordering Party's infrastructure is confidential.
8.2.8. The costs associated with participating in the site visit, especially those related to travel, are borne solely by the Contractor.
8.3. The fact of conducting a site visit will be documented by a attendance list, which will be prepared during the visit at the location of its execution.
