In March 2025, the Sibiu Clinic Hospital for Children, as the beneficiary of the funding and lead partner with the Municipality of Sibiu, signed with the Ministry of Health, as the coordinator of reforms and investments for the PNRR, Component 7, Specific Investment I3.3, the financing contract no. 2065/130/I.3.3/10.03.2025, aimed at implementing the project "DIGITALIZATION OF THE SIBIU CLINIC HOSPITAL FOR CHILDREN," funded through the National Recovery and Resilience Plan, Component C7 – Digital Transformation I3. The realization of the eHealth and telemedicine system; Specific investment: I3.3 – Investments in the information systems and digital infrastructure of public healthcare units, CALL CODE MS-733. At the date of this procedure, the duration of the financing contract is until 30.09.2025 and may be extended for the entire period of PNRR implementation. The contracting authority has proceeded to request an extension of the duration of the financing contract beyond the deadline of 30.09.2025. Suspensive clause: The awarding of the public procurement contract is initiated under the incidence of this suspensive clause, meaning that the signing of the public procurement contract is conditional on the allocation of funds in the hospital budget, according to financing contract no. 2065/130/I.3.3/10.03.2025. Given the provisions of Law no. 98/2016 regarding public procurement and HG no. 395/2016, with subsequent amendments, the contracting authority specifies that it will sign the contract with the declared winning bidder only to the extent that the necessary funds for the purchase will be allocated in the hospital budget. In case, for any reason, the funds are not approved, the awarding procedure will be annulled as a matter of right, in accordance with the provisions of Article 212 paragraph (1) letter c) second thesis of Law no. 98/2016 with subsequent amendments, making it impossible to conclude the public procurement contract. Tenderers in this procedure understand that the contracting authority cannot be held responsible for any damages in the event of the annulment of the awarding procedure, regardless of their nature and regardless of whether the contracting authority has been notified of the existence of such damage. Tenderers in this procedure accept the use of the above special conditions/suspensive clause, assuming full responsibility regarding any damages they may suffer in the described situation. The maximum estimated term during which the suspensive clause applies is 30.09.2025. Considering the provisions of Law 98/2016 regarding public procurement and HG no. 395/2016, with subsequent amendments, the contracting authority specifies that it will conclude the contract with the declared winning bidder only to the extent that the necessary funds for the purchase are ensured by the allocation of budget credits for this purpose. In case, for any reason, budget credits are not allocated, the contracting authority, after receiving notification regarding the non-approval of funding, reserves the right to annul the awarding procedure, provided that there is no other source of funding, in accordance with the provisions of Article 212 paragraph (1) letter c) second thesis of Law 98/2016 with subsequent amendments, making it impossible to conclude the public procurement contract. Tenderers in this procedure understand that the Contracting Authority cannot be held liable for any damages in the event of the annulment of the awarding procedure, regardless of their nature and regardless of whether the Contracting Authority has been notified of the existence of such damages. Tenderers in this procedure accept the use of the above special conditions/suspensive clause, assuming full responsibility for any damages they may suffer in the described situation, in the event of annulment of the procedure or if they do not conclude the public procurement contract due to lack of funding.

From this perspective, the clinical components ensure, on the one hand, optimal management of medical data, facilitating their use, storage, and transfer, and on the other hand, allowing efficient planning of the material and human resources of the institution, facilitating communication and collaboration between the different departments in the hospital. The number of days until clarification requests can be made before the deadline for submitting offers is 18 days. The contracting authority will respond clearly and completely to all requests for clarifications on the 11th day prior to the deadline for submitting offers.
