1. The subject of the contract is the delivery of infrastructure and software for the needs of production environments divided into 3 parts: part 1 - expansion of the two OpenShift containerization platforms owned by the Ordering Party, part 2 - delivery of Oracle or equivalent software along with the provision of technical support for a period of 36 months and part 3 - delivery of software for the expansion of the functionality of IBM POWER servers with technical support.
2. The subject matter of the contract is described in detail in Chapter II of the Terms of Reference – Description of the subject matter of the contract.
3. Pursuant to Article 139 of the Public Procurement Law, the Contracting Authority provides for a reversed order of evaluation of bids, i.e. it will first examine and evaluate bids, and then it will qualify the Contractor whose bid has been rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
4. The Contracting Authority is the administrator of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.4.2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, hereinafter referred to as "GDPR".
5. The Contractor submits an offer via the eProcurement Platform of the Public Procurement Office - https://ezamowienia.gov.pl/pl/.
6. The Contracting Authority reserves the right to cancel the procurement procedure if the public funds which the Contracting Authority intended to allocate to finance the contract are not granted.
7. The Offer shall be submitted, under pain of nullity, in electronic form, in accordance with the requirements strictly specified in the Terms of Reference.
8. The Contracting Authority will not award the contract if the circumstances referred to in Article 5k of the Council Regulation (EU) No. 833/2014 of 31 July 2014 concerning organisational measures in connection with Russia's actions destabilising the situation in Ukraine (DZ. UE No. L 229/1 of 31.7.2014) and will exclude the Contractor in the event of the occurrence of at least one of the grounds for exclusion specified in Article 7(1) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and for the protection of national security (i.e. Journal of Laws of 2023, item 1497, as amended) – in order to confirm the lack of attitudes to exclusion, a statement constituting Appendix No. 8 to the Offer form. In the case of joint application
a declaration shall be made by each of the Contractors.
9. The Contractor undertakes to perform the subject matter of the Contract within the following deadlines:
Part 1:
1) Within 20 Working Days from the date of conclusion of the contract, the Contractor shall agree with the Ordering Party and submit by e-mail the final version of the plan for the installation, configuration and commissioning of the delivered Devices, together with the Software. The plan will also include the planned delivery dates of the Devices and the Software to each Location, as well as the dates of installation, configuration and commissioning.
2) delivery of expansion devices with software to each of the Locations, within a maximum of 90 days from the date of conclusion of the contract - is a criterion for the evaluation of offers,
3) installation, configuration and commissioning of devices and software, along with the provision of licenses to the Software, within 21 working days from the date of delivery of the devices,
4) the equipment will be covered by the manufacturer's warranty service or the manufacturer's authorized service partner for a period of 36 months from the date of signing the quality acceptance protocol by the parties without reservations,
5) licenses for the Software will be covered by technical support along with access to updates from the manufacturer's official channel, for a period of 36 months from the date of signing the quality acceptance protocol by the parties without reservations.
Part 2:
1) delivery of the software within 16 working days from the date of conclusion of the contract,
2) providing technical support for a period of 36 months from the date of delivery of the subject of the contract;
Part 3:
1) delivery of the software with appropriate licenses within 10 working days from the conclusion of the Agreement,
2) providing technical support for the period from the date of delivery to 30.10.2025.
