Description:
Provision of services in the field of forest management in the area of the Herby Forest District in 2024

The subject of the contract are services in the field of forest management in accordance with the provisions of Article 6(1)(1) of the Act of 28 September 1991 on Forests (consolidated text: Journal of Laws of 2023, item 1356 – "Forest Act") including works in the field of forest cultivation and protection, fire protection, timber harvesting and harvesting to be performed in the area of the Herby Forest District in 2024. The place of execution of the subject of the contract will be the administrative area of the Herby Forest District. The implementation of works included in the subject matter of the contract for individual Packages will take place in the area of forestry – specific to a given Package. The material scope of the subject matter of the contract includes the total amount of works in the field of forest cultivation and protection, fire protection, timber harvesting and harvesting resulting from Appendix No. 2 to the Terms of Reference. The material scopes listed in the appendices included in Appendix 2 are estimates.

Provision of services in the field of forest management in the following forestry areas: Blachownia, Aleksandria, Hutki, with the exception of services: mechanical shredding of wood residues and moss. Soil preparation

1. The subject of the contract are services in the field of forest management as defined in Article 6(1)(1) of the Forest Act of 28 September 1991 (consolidated text: Journal of Laws of 2023, item 1356 – "Forest Act") including works in the field of forest breeding and protection, fire protection, wood harvesting and harvesting and to be performed in the area of the Herby Forest District in 2024.

2. The material scope of the subject matter of the contract includes the total quantities of works in the field of forest cultivation and protection, fire protection, timber harvesting and harvesting and resulting from Appendix No. 2 to the Terms of Reference, which consists of:

Incl. No. 2.1. – planned size of works; Incl. No. 2.2. - detailed size of works by groups of activities, activities and location; Incl. No 2.3.1 — Forestry characteristics for timber harvesting; Incl. No 2.3.2 — Forest harvesting assortment system; Incl. No 2.3.3. — Summary of distances and conditions of skidding wood; Incl. No 2.3.4. — list of items with additional difficulties in terms of acquisition and skidding; Incl. No 2.3.5. – list of items not made available for machine acquisition; Incl. No 2.3.6. – Information on the optimal technology of logging (potential); Incl. No. 2.4.1. - information on the nature of forest care (zones for mowing weeds); Appendix No. 2.4.2. - list of items not available for renewal made with the help of a planter; The material scopes listed in the annexes included in Annex 2 are estimates.

3. Quality standards relating to all essential features of the subject of the contract are specified in Annex 3 to the SWZ, which consists of:

Incl. No 3.1. "Description of the standard of forestry work execution technology",

Incl. No 3.2. Description of the standard of forestry work execution technology in the Regional Directorate of State Forests in Katowice adopted by Decision No. 71 of the Regional Director of the State Forests of 10 October 2023 on the implementation of the "description of the standard of forest work execution technology" in the forest districts of the Regional Directorate of State Forests in Katowice.

Specified in Appendix. no. 3.1. to the Terms of Use and Appendix No. 3.2. to the Terms of Reference, a detailed description of the standard of technology for the performance of individual forestry works (activities) is the basis for determining the quality requirements relating to the elements constituting the subject of the contract (Appendix No. 2 to the Terms of Reference). If the activity described in the above-mentioned appendices is not provided for in the description of the subject matter of the contract (Appendix No. 2 to the Terms of Reference), then in this respect the provisions of Appendix. No. 3.1 to the SWZ and Appendix. No 3.2 shall not apply to the Terms of Reference.

4. Descriptions of activity codes describing individual forest works (activities) included in the subject of the contract are described in Annex 3 to the SWZ.

5. A description of the rules of the procedure for the acceptance of forest works is included in Annex 3 to the SWZ.

6. Pursuant to Article 95 of the Public Procurement Law, the Contracting Authority requires the Contractor or subcontractor to employ persons performing activities related to the performance of the contract, consisting in obtaining and harvesting wood raw material, if the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – the Labour Code (consolidated text: Journal of Laws of 2023, item 1456, as amended. amended).

7. A full description of the subject of the contract is contained in part 3 of the SWZ.

8. The Contracting Authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Public Procurement Law within 3 years from the date of awarding the basic contract. The material scope of these services will not exceed the value of 50% of the value of this contract.
