The subject of this order is the comprehensive supply (sale and distribution) of high-methane type E natural gas for the needs of Uzdrowisko Rymanów S.A. in Rymanów-Zdrój in the period from 01.01.2024 to 31.12.2024. The Contractor will be obliged to ensure the quality parameters of the gaseous fuel, the quality standards of the Contracting Authority's service and the method of handling complaints in accordance with the applicable provisions of the energy law, in particular with Chapter 8 of the Regulation of the Minister of Economy of 2 July 2010 on the detailed conditions for the operation of the gas system (i.e. Journal of Laws of 2018, item 1158, as amended).

1) The subject of this order is a comprehensive supply (sale and distribution) of high-methane natural gas type E for the needs of Uzdrowisko Rymanów S.A. in Rymanów-Zdrój in the period from 01.01.2024 to 31.12.2024.

2) The Contractor will be obliged to ensure the quality parameters of the gaseous fuel, the quality standards of the Contracting Authority's service and the method of handling complaints in accordance with the applicable provisions of the energy law, in particular with Chapter 8 of the Regulation of the Minister of Economy of 2 July 2010 on the detailed conditions for the operation of the gas system (i.e. Journal of Laws of 2018, item 1158, as amended).

3) Detailed data on the collection points of the current tariff groups, contracted capacity and forecasted consumption are included in Appendix 1.2 to the OPZ "List of units, consumption points with forecast consumption".

(4) The data referred to in Appendix 1 to the Terms of Use shall constitute a forecast of gas consumption and shall be

only for the purpose of comparing the submitted bids, but in no case do they constitute an obligation on the part of the Contracting Authority to purchase gas in the quantities indicated in the annex.

5) During the term of the contract, the Contractor will supply gaseous fuel in an amount corresponding to the actual demand of the Contracting Authority, regardless of the estimated consumption forecast.

6) The supply of gaseous fuel will take place on the basis of an agreement containing the provisions of the sales agreement and the gas distribution services agreement,

in accordance with applicable law, in particular in accordance with the Energy Law of 10 April 1997 (Journal of Laws of 2022, item 1385, as amended)

7) The Contractor is obliged to perform all actions and arrangements with the

Distribution System Operator (DSO) necessary to carry out the procedure of changing the supplier, whereby the Contracting Authority informs that it is currently carrying out a comprehensive supply of gaseous fuel on the basis of a contract concluded for a definite period of time, i.e. until 31.12.2023.

8) The Contracting Authority's facilities are subordinate to the Branch of the Gas Plant in Tarnów of Polska Spółka Gazownictwa sp. z o.o.

9) The Contractor is obliged to keep the Contracting Authority informed about the contractual power performed. If it is not possible to include this information on the invoice, it may be presented as an attachment to the invoice.

10) The Contracting Authority is partially exempt from excise duty pursuant to Article 31b(2) of the Excise Duty Act of 6 December 2008 (Journal of Laws of 2022, item 143) – Appendix No. 1.4 to the OPZ

11) The Contracting Authority declares that the collection points of the organisational units indicated in the

Appendix 2a to the Terms of Use shall be subject to the tariff protection provided for in the

Act of 26 January 2022 on Special Solutions for the Protection of Gas Fuel Consumers in Connection with the Situation on the Gas Market (Journal of Laws of 2022, item 202)
