1. The subject of the contract is the preparation of complete and comprehensive design documentation along with the submission of an effective notification of works that do not require a building permit / obtaining a valid (final) building permit / obtaining a final (final) decision for the implementation of a road investment (ZRID) for the task: "Construction of a rainwater drainage system in Główna Street".
2. A detailed description of the subject matter of the contract is included in Appendices No. 7 to the Terms of Reference.
3. The requirements arising from Article 100 of the Public Procurement Law have been included in §19 of the Draft Provisions of the Agreement, constituting Appendix No. 6 to the Terms of Reference.
4. The present procedure is part of a contract announced in separate procedures. The order is not divided into parts, due to the specifics of the order. The project requires coordination of the entire issue together.
1. In the design documentation which is the subject of this contract, the contractor should take into account and design in particular the following elements for the entire scope:a complete new rainwater sewage system constituting a drainage system of the road system with extensions to individual plots (or to a group of plots) understood as a new, coherent and connected drainage system of the road and adjacent plots, together with devices and necessary equipment, including, among others, wells, inlets, pipelines, collisions, protections, etc., retention reservoir / pumping station / pressure pipeline – depending on the needs and design assumptions,
- reconstruction of the road surface after sewage works - asphalt concrete roadway of the L-class road - local with a structure for the KR-3 traffic category (substructure, ground preparation, possible reinforcements, stabilizations, curbs, edges, etc.). The Contracting Authority expects the design documentation to be phased into at least 2 scopes of pavement restoration, i.e. half reconstruction after sewage works and reconstruction of the entire width of the road surface, details will be agreed with the Contracting Authority at the stage of documentation implementation, pavement / paved shoulder, inventory of roadside greenery including trees and shrubs to be felled along with obtaining an appropriate decision for felling – depending on the needs and design assumptions. A detailed description of the contract is included in Appendix No. 7 to the Terms of Reference.
2. The offer and attachments to the offer should consist of the following files:
1) a completed offer form (Appendix 1 to the specification), i.e. an offer, 2)a statement referred to in Article 125(1) of the Public Procurement Law - ESPD (according to Appendix 2 to the specification), 3) declaration of non-exclusion pursuant to Article 5k of Regulation 833/2014, as amended by Council Regulation (EU) 2022/576 of 8 April 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in the Ukraine (Annex 3 to the specification), 4) an excerpt or information from the National Court Register, the Central Registration and Information on Business or another relevant register confirming that the person acting on behalf of the contractor is authorised to represent the contractor – provided that the offer is submitted by a person conducting business activity or an entity entered in the above-mentioned registers. The contractor is not obliged to submit a document if the contracting authority can obtain it using free and publicly available databases, provided that the contractor provides data enabling access to these documents, and if applicable
5) power of attorney to act on behalf of the contractor, if a person other than the person authorized to represent the contractor has been indicated in the document confirming the authorization to represent the contractor,
6) in the case of reliance on the resources of the entity providing resources – the obligation of the entity providing resources referred to in Article 118(3) of the PPL,
7) in the case of reliance on the resources of the entity providing the resources – the statement referred to in Article 125(1) of the Public Procurement Law (PPL) of the entity providing the resources,
8) in the case of submission of a bid by contractors jointly applying for the award of a contract – a document confirming the appointment of a representative in accordance with Article 58(2) of the PPL,
9) in the case of submission of a bid by contractors jointly applying for the award of a contract – a statement referred to in Article 117(4) of the PPL.
3.In the case of joint bidders, the provisions of points 2(2), (3), (4) and (5) of point 2 shall apply mutatis mutandis.
4.Points (4) and (5) of point 2 shall apply mutatis mutandis to a person acting on behalf of an entity providing resources in accordance with Article 118 of the PPL.
5. Along with the offer, the contractor is obliged to submit a statement of non-exclusion and fulfilment of the conditions for participation in the tender. The declaration must be made on the form. EAT.
