The subject of the contract is the provision of services for the collection, transport and development of solid municipal waste from real estate inhabited from Niepołomice Municipality, consisting of:
- equipping residents with mixed waste containers,
- to provide owners of the property with bags for municipal waste collected selectively and to prepare and deliver to residents, waste export schedules”,
- reporting - monthly reports,
The service also includes the provision by the Contractor of access to hard-to-reach points (dirt roads, narrow roads, running through wooded areas, forests) particularly burdensome during the period of increased rainfall and snowfall, by organizing all means of transport that will enable the collection of waste from address points with a problematic location - resulting from poor technical parameters of roads

Attention:
The amount of actual collected and developed unsegregated (mixed) municipal waste and received and processed selectively collected municipal waste may differ from the declared and will depend on the actual demand of the Contracting Authority, and the Contracting Authority will not incurred no consequences from this title. The maximum quantities provided in the description of the item /request of the order are only estimates.
Requirements referred to in Article 95 Pzp.
1. Since the performance of this contract must be carried out by performing activities under the conditions specified in Article 22 § 1 of the Act of 26 June 1974 Labour Code - for the contractor or subcontractor, at the place and time indicated by the contractor or subcontractor - the contracting authority, in accordance with Article 95 paragraph 1 of the PPL, requires the contractor or subcontractor to employ persons performing activities falling within the so-called direct costs on the basis of an employment relationship. This requirement applies to persons who perform activities directly related to the performance of services covered by the subject of the contract, i.e. so-called manual workers, in particular:
1) related to the collection and export of municipal waste from property owners, in particular operators, drivers, loaders,
2) acting as coordinator (and, in his absence, deputy).
2. The method of documenting the employment of persons referred to in Article 95 of the PPL. The Contractor is obliged to submit to the contracting authority, at its request, within the time limit specified in the application, documents confirming the employment of persons performing the activities referred to above, in particular a written statement of the contractor or subcontractor confirming that the contractor's or subcontractor's employees are employed under an employment contract within the meaning of the provisions of the Act of 26 June 1974 - Labour Code, taking into account the minimum wage for work determined on the basis of Article 2(3)-(5) of the Act of 10 October 2002 on the minimum wage for work (Journal of Laws of 2020, item 2207, as amended). This statement should contain in particular: a precise definition of the entity submitting the declaration, the date of submitting the statement, an indication that the activities listed in point 1 are performed by persons employed under an employment contract together with an indication of the number of such persons, the type of employment contract and the length of time and the signature of the person authorized to submit the statement on behalf of the contractor or subcontractor.
3. The contracting authority to control compliance by the contractor with the requirements referred to in Article 95 of the law pzp. are described in the draft contract annexed to the SWZ.
