1. The subject of the contract is the implementation of construction works for the investment task entitled “MINIMIZATION OF THE HAZARDS OF WATER CONTAMINATION TOGETHER WITH INCREASING OPTIMIZATION OF TREATMENT PROCESSES BY MODERNIZATION OF WATER TREATMENT STATION “STARGARD-SOUTH” under priority programme No. 5.4” Interdisciplinary. The Contracting Authority shall require the subject of the order to be executed in accordance with the requirements of this SWZ.

3. A detailed description of the subject matter of the contract is contained in Annex 3 to SWZ - Draft Agreement, in particular in the documents constituting Annexes No 4 and 7 to the draft contract.

4. In all the provisions of the SWZ and its annexes where the Contracting Authority refers to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 (1) (2) and (3) of the PZP, the Contracting Authority shall indicate that in accordance with Article 101 (4) of the PZP, the Contracting Authority shall indicate that in accordance with Article 101 (4) solutions equivalent to the described. Where the description of the subject of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 (1) (2) and paragraph 3 of the PZP, the Contracting Authority shall not reject the tender only because the works offered do not comply with standards, technical assessments, technical specifications and technical reference systems to which the description of the subject of the contract refers, provided that the contractor proves in the offer that the proposed solutions meet the requirements set out in the subject description orders.

5. The subject of the contract is not divided into tasks (parts) because due to technological and implementing reasons and rational expenditure of public funds there is no possibility to divide the order into parts. This would risk undue technical difficulties, the costs of executing the order, as well as the need to coordinate the actions of various contractors carrying out individual parts of the order, which could affect the safety of providing water supplies for residents. In addition, there would be a risk of failing to perform part of the order and thus preventing the exploitation of the Stargard-South Water Reception.
