The subject of the sectoral contract shall be the provision of public transport bus services in the area of operation of the Contracting Authority, under the principles laid down in Annex No 7 to the SWZ — the draft provisions of the contract, also referred to as the “contract model”.
The order is divided into seven parts also called “Segments”.
“West B” segment1. The subject of the sector contract is the provision of public bus services in the area indicated in Section II.2.3) of the notice (the main area in which the services will be provided).
2. The basic scope of operational work expressed in carriages (also referred to as “carriage”) to be commissioned by the Contracting Authority shall be:
Operational work [carriage] broken down by type of rolling stock — basic range for period: 01.01.2022 year - 31.12.2029 year: MN - 6,291 711 carriages; AN - 1 061 574 carriages; NPC - 15,357,170 carriages; CN - 3,023 381 carriages. Total 25,733,836 carriages.
3. The Contracting Authority reserves the right to reduce the scope of the basic contract in each year of service performance (from 1 January to 31 December of the year in question), in any type of rolling stock (MN, AN, BN, CN), to a value of not less than guaranteed operation in each year and type of rolling stock, which is 85% of the operational work specified in section 2.
4. The dates for changes in the volume of operational work and the resulting change in the number of vehicles operating the Segment are set out in point 3.5. Specification of the Order Terms (SWZ).
5. The Contracting Authority shall require that, from 1 January 2023, all vehicles be equipped with air conditioning of the passenger compartment complying with the requirements described in Annex No 7 to the SWZ, in particular Annex No 1 to the model contract.
6. The Contracting Authority shall require that, from 1 January 2023, all vehicles be equipped with a monitoring system complying with the requirements described in Annex No 7 to the SWZ, in particular Annex No 1 to the model contract.
7. The Contracting Authority requires that from 1 January 2023 all vehicles be equipped with USB chargers that meet the requirements described in Annex 7 to the SWZ, in particular Annex 1 to the model contract.
8. The Contracting Authority shall require that, from 1 January 2023, all vehicles be fitted with a device preventing the engine from starting by a driver under the influence of alcohol complying with the requirements described in Annex No 7 to the SWZ, in particular Annex No 1 to the model contract.
9. The Contracting Authority shall require that, from 1 January 2022, all vehicles be equipped with a Passenger Information System that meets the requirements described in Annex No 7 to the SWZ, in particular Annex 8a to the model contract. The dates for the introduction of selected functionalities are set out in Annex No 8a to the model contract.
10. The Contracting Authority shall require that, within 3 months from the date of conclusion of the Agreement, all vehicles carrying out the subject of the contract have the colour scheme of outer seats in yellow [RAL 1018].
11. Pursuant to Article 95 (1) of the Pzp Act, the Contracting Authority requires employment by the Contractor or subcontractor on the basis of the employment relationship of drivers of vehicles, i.e. persons carrying out driving activities involving the performance of work in the manner laid down in Article 22 (1) of the Act of 26 June 1974 - Labor Code (Journal of Laws of 2020 item 1320).
12. The method of verification of employment referred to in paragraph 11, the Contracting Authority described in paragraph 3.13 SWZ.

5. The Contracting Authority shall require that, from 1 January 2023, all vehicles be equipped with air conditioning of the passenger compartment complying with the requirements described in Annex No 7 to the SWZ, in particular Annex No 1 to the model contract.
6. The Contracting Authority shall require that, from 1 January 2023, all vehicles be equipped with a monitoring system complying with the requirements described in Annex No 7 to the SWZ, in particular Annex No 1 to the model contract.
7. The Contracting Authority requires that from 1 January 2023 all vehicles be equipped with USB chargers that meet the requirements described in Annex 7 to the SWZ, in particular Annex 1 to the model contract.

The Contracting Authority shall require that, from 1 January 2023, all vehicles be fitted with a device preventing the engine from starting by a driver under the influence of alcohol complying with the requirements described in Annex No 7 to the SWZ, in particular Annex No 1 to the model contract.

4. The dates for changes in the volume of operational work and the resulting change in the number of vehicles operating the Segment are set out in point 3.5. SWZ.
