The subject of the contract is the successive delivery of medicinal products to the Outpatient Clinic Pharmacy with the Sick Chamber of the Detention Center in Lublin, divided into three parts, a detailed description of the subject of the contract as to the assortment and quantity is listed in Annex 3 to this specification of the terms of the contract (which at the same time constitutes a sheet for the valuation), respectively for individual parts – constituting an integral part of this SWZ. The quantities given are an estimate of the demand for a period of 12 months. The quantities given are an estimate of the demand for a period of 12 months. The Ordering Party reserves the right to resign from the purchase of some articles due to the lack of demand for a given assortment or to reduce demand. The contractor may, while maintaining the form and dose of the medicine, offer a chemically equivalent pharmaceutical product (generic), with a different pack size than that specified in the Annex, while retaining the total number of unit items required (tablets, ampoules, etc.), in which case the number of packages should be converted and rounded up to the full package. The Ordering Party allows the possibility of valuing alternative forms of injection molds – e.g. ampoule vial. The Ordering Party allows the possibility of valuation of replacement forms of oral preparations, i.e.:

tablets – film-coated tablets, capsules (including hard and flexible) or dragees;

film-coated tablets – tablets, capsules (including hard and flexible) or dragees;

capsules (including hard and flexible) – film-coated tablets, tablets or dragees;

dragees – capsules, tablets or film-coated tablets;

Instead of (tablets, coated tablets or hard and flexible capsules) with slow action – with modified action. The customer does not allow insulin changes. All medicinal products must have a drug registration (marketing authorization) in accordance with the Pharmaceutical Law or the status of a medical device within the meaning of the provisions of the Act on medical devices. For each medical device, at the request of the Contracting Authority, the Contractor shall provide a declaration of conformity. The Ordering Party does not allow the delivery of medicinal products that are dietary supplements or cosmetics. The validity period of the offered products may not be shorter than 1 year (counting from the date of delivery) until the end of the shelf life, unless the Ordering Party agrees to accept the product with a shorter expiry date. The Ordering Party may accept generics (equivalents) of pharmaceutical products at the disposal of the Contractor, as part of the offered assortment. In this case, the Ordering Party shall pay for the delivered generics (equivalents) a price not higher than the price of the product from the signed contract. Estimates of supplied medicinal products listed in Annex 3 (part 3). I) may be changed during the term of the contract while maintaining the unit price, provided that the value of the contract is not exceeded. The final number of ordered articles will result from the actual needs of the ordering party during the term of the contract. The Ordering Party allows the replacement of the preparation priced in the tender offer with another equivalent one while maintaining the unit price (suspension or termination of production).

II) may be changed during the term of the contract while maintaining the unit price, provided that the value of the contract is not exceeded. The final number of ordered articles will result from the actual needs of the ordering party during the term of the contract.
