The Federal Office for Freight Transport intends to make use of advisory services for control technology (control components and control system components) used or to be used in the control service of the Federal Office, in order to be able to carry out the control tasks even if the legal or technical requirements change. This includes, in particular, event-related advisory services to be commissioned in individual (possibly successive) thematic blocks for the further development of inspection vehicles or portable inspection devices, inter-inspection vehicle concepts, other individual inspection components or inspection-technical issues. As a rule, at least rudimentary technical validation measures will have to be performed by the contractor in order to ensure the effective technical and economic feasibility of control changes for subsequent procurement processes of the client. The series-ready product development of the consulting results found is not the subject of this tender.
The subject of this framework agreement are consulting services of the contractor (AN) in connection with the (further) development of effective (see above) control technology for the client BAG (AG), which are to be provided on the basis of individual orders placed.
The consulting services to be provided by the contractor are divided into 3 areas:
- Analysis and further development (see a);
- Validation of consulting results (see b);
- Support for tender projects (see c).
The services of the AN are not the specific development, production and provision of control technology ready for series production. This should be awarded on the basis of the services of the contractor in the competition, taking into account the consulting results.
The consultancy services of the contractor take place regularly in an early phase, e.g. before the tenders for the development / production of control technology or during the tender process. The services of the AN must serve in particular to specify requirements, specifications, etc. for the subsequent processes.
The objects, scope and objectives of the consultation are specified and specified by the client as required by the client. As a rule, these are subsystems / components of control technology. The contractor must always take into account the dependencies, influences and effects of the object of the advice in relation to the entire control-technical environment and take them into account in the results of his advice.
The consulting services can also include individual activities for the preparation and implementation of the subsequent processes, e.g. the preparation and support of procurement projects under public procurement law (e.g. preparation of tender documents, in particular the definition of requirements and the formulation of a service description, etc.). As a result, possible conflicts of interest of the Contractor or its subcontractors with regard to subsequent award procedures cannot be ruled out. The examination in individual cases is subject to the possibility of the Contractor participating in an award procedure based on his consulting results in accordance with Sections 6, 7 of the Award Ordinance (VgV) or Sections 4 and 5 of the Sub-Threshold Award Ordinance (UVgO).
If necessary, the Contractor undertakes to provide the AG with consulting services in the manner set out in the order documents. This means that there is no entitlement to an order for all or individual subject areas, nor is there a claim to be commissioned exclusively for individual advisory topics.
According to the client's specifications, the contractor must always hand over his consulting results for subsequent procurement procedures in terms of form, format, deadline and content, without restriction of usability by the client, e.g. B. in terms of licensing, copyright or patent law.
