Description:
Purchase and implementation of a financial and accounting system in the Olsztyn Commune

The subject of the contract is design, execution, delivery, configuration, integration, implementation, testing and launching of the financial and accounting system in the Olsztyn commune.

A detailed description of the subject of the contract is included in Annex 1 to the contract template - entitled "Assumptions for the financial and accounting system in the Olsztyn Commune."

1. The subject of the contract is the design, implementation, delivery, configuration, integration, implementation, testing and launching of a fully functional financial and accounting system that will allow for the introduction of a uniform and coherent tool for managing the finances of the Olsztyn City Hall and subordinate units in accordance with the provisions of this ToR and on the conditions set out in the model public procurement contract

2. The offered system must meet the requirements of the Regulation of the Council of Ministers of April 12, 2012 on the National Interoperability Framework, minimum requirements for public registers and exchange of information in electronic form, as well as minimum requirements for ICT systems / i.e. Dz. Of Laws of 2017 Pos. 2247 as amended /, including:

1) specification of data formats as well as communication and encryption protocols to be used in the interface software,

2) ways to ensure security when exchanging information,

3) technical standards ensuring the exchange of information with the participation of public entities, including cross-border exchange.

3. The contracting authority provides for the possibility of awarding contracts referred to in art. 67 sec. 1 point 7 of the Act, up to 20% of the value of the basic order consisting in the addition of new functionalities not covered by the contract only if the limit of adaptation works is exhausted before the expiry of the guarantee period.

4. The contracting authority provides for an inverted procedure, referred to in art. 24aa of the PPL Act. According to art. 24aa of the Public Procurement Law, the Awarding Entity will first evaluate the bids and then examine whether the Contractor whose bid is initially assessed as the most favorable, is not subject to exclusion and meets the conditions for participation in the procedure. The contracting authority will perform activities resulting from art. 87 and art. 89 and art. 90 clause 1 of the Act. However, in relation to the pre-selected Contractor, he will perform a subjective analysis in terms of the grounds for exclusion and fulfillment of the conditions for participation in the procedure.

5. Each Contractor is obliged to secure a bid security of PLN 400,000.00 9 (four hundred thousand zlotys).

6. The contractor, before signing the contract, will be required to provide a security on due performance of the contract for the amount of 10% of the total price / gross / given in the offer.

7. Before commencing the procedure for awarding a public contract in order to prepare a description of the subject of the contract, the Commune of Olsztyn pursuant to art. 31a - 31d of the Act conducted a technical dialogue. The documentation of the technical dialogue conducted by the Olsztyn Commune constitutes an attachment to the ToR (protocol from the conducted technical dialogue).
