Description:
The contract involves supplying computer equipment to Kazimierz Pułaski Radom University, including a complete HPC/AI class GPU server set and portable computers, with specific delivery deadlines and warranty requirements.

1. The subject of the contract is the supply of computer equipment for Kazimierz Pułaski Radom University, divided into two (2) parts (packages). The Purchaser allows for the submission of offers for individual parts - packages and does not limit the number of parts - packages that may be awarded to a single Contractor.
2. The subject of the contract includes the delivery of computer equipment to the location indicated by the Purchaser:
Package I: Complete HPC/AI class GPU server set intended for conducting educational, research and development, and computational tasks in the field of artificial intelligence, deep learning, computer vision, numerical modeling CFD, digital twins, and large-scale data analysis - 1 set.
Package II: Portable computers – 8 units.
3. A detailed description of the subject of the contract is included in Annex No. 2 to the SWZ – Description of the Subject of the Contract (OPZ).
4. Delivery deadline:
Package I – within 90 days from the date of contract conclusion,
Package II – within 28 days from the date of contract conclusion. The Purchaser will score the shortening of the delivery period in the bid evaluation criteria.
5. The Purchaser informs that it will apply for a 0% VAT rate on computer devices, based on Article 83 section 1 point 26 of the Act of March 11, 2004, on Goods and Services Tax (Journal of Laws of 2023, item 1570 as amended).
6. If the Purchaser obtains consent for the application of the 0% rate, the Contractor will refund the applicable VAT. The refund will be made based on the corrective invoice issued within 7 days from the date of invoice issuance.
7. The Contractor guarantees that the delivered equipment is brand new, unused, unreconditioned, undemonstrated, free from defects, and meets the requirements specified in the description of the contract.
8. The Contractor is obliged to deliver brand new, unused, and never before activated operating systems from a legal source of sale.
9. During the warranty period, the Contractor will provide free-of-charge warranty repairs at the location where the equipment is installed. The maximum repair time is set at 14 days from the date of notification. The Contractor is obliged to take all actions during the warranty period to ensure the proper functioning of the equipment.
10. The Purchaser may exercise warranty rights independently of rights arising from a warranty for defects of the object of the contract.
11. In the event that the repair of the equipment is not possible or in case of three consecutive unsuccessful repairs (i.e., the equipment fails again), the Contractor will replace the defective equipment with new one if the equipment of the same brand and model cannot be supplied – with equipment of not worse parameters – after consultation with the Purchaser.
12. The Contractor bears all costs related to the repair or replacement of the equipment, including travel, delivery, and installation on the Purchaser's premises.
13. The Contractor provides a warranty on the computer equipment for the period specified in the Offer, not less than: − 36 months from the date of handover of the equipment for operation, based on a signed acceptance protocol.
14. The Contractor is obliged to state in the offer the model and manufacturer of the proposed devices and additional data for: servers and company computers – processor model and graphics card if it is an additional unit not integrated with the processor, provided that it is assumed that mass-produced servers and computers are equipped with a motherboard from the same manufacturer as the entire server and computer, the name of the manufacturer must be permanently entered in the BIOS, and technical data must be available on the manufacturer's website in Polish or English – in accordance with and accordingly with the Price Forms forming Annexes No. 1a and 1b to the Offer.
15. The Purchaser foresees the possibility of changing the provisions of this agreement concerning the suspension of production (which could not be predicted) of the specified equipment model, provided that the Contractor delivers equipment with technical parameters no worse than those specified in the original offer and provided that the price of equipment with new technical parameters does not increase.
16. The Purchaser requires that the subject of the contract meets the accessibility requirements for people with special needs, specified in the Act of July 19, 2019, on ensuring availability to people with special needs (Journal of Laws of 2024, item 1411), the Act of April 4, 2019, on the digital accessibility of websites and mobile applications of public entities (Journal of Laws of 2019, item 1440) and in the Act of April 26, 2024, on ensuring the accessibility requirements of certain products and services by economic entities (Journal of Laws of 2024, item 731), as well as being implemented according to the principles of universal design for all individuals (including those with special needs, disabilities).
17. In cases where ensuring accessibility is not possible for technical or organizational reasons, the Purchaser and Contractor will provide reasonable improvements, understood as necessary and appropriate adjustments that do not impose disproportionate or excessive burdens and are necessary for people with special needs or disabilities to effectively use the services, products, or results of the contract execution.
18. The description of the subject of the contract is prepared with consideration of accessibility requirements specified in Article 100 of the Act of September 11, 2019, Public Procurement Law (Journal of Laws of 2024, item 1320 as amended).
