the Mediterranean coast this opinion follows a first opinion declared without action (see its reference to section IV.3.2). It concerns a

defence or security contract with the object “Maintenance in operational condition of the medium

tonnage vessels of the French Navy and the DGA based mainly on the façade. Mediterranean”. It is a

composite framework agreement, partially with purchase orders. Pursuant to articles R2313-2, R2391-8 to R2391-

10 of the Public Order Code, it comprises one or more tranche (s) optional according to modalities that

will be explained in the consultation file. The firm tranche includes a firm share and a part

to purchase orders executed according to the provisions of Article R2362-8 of the Public Order Code and

orders for supplies or services intended to provide for possible technical hazards in application of

articles R2372-19 to R2372-21 of the Public Order Code.

The framework agreement is a single-member agreement.

It is passed according to a procedure with negotiation in accordance with the provisions of Articles L2324-3, R2324-3 and

R2361-8 to R2361-11 of the Public Order Code.

- the services requested will be carried out either as part of a firm share and/or by means of

order forms in application of Article R2362-8 of the Public Order Code,

- in application of articles R2372-19 to R2372-21 of the Public Order Code, the needs subject to the

framework agreement presenting significant technical hazards, it will include a provisional share for orders for
