The subject of the contract is the provision of maintenance and development services for the Ministry Portals. A detailed description of the subject of the contract is included in Annex 1 to the ToR. The contracting authority reserves that it may first evaluate the offers and then examine whether the contractor whose offer has been assessed as the most advantageous is not subject to exclusion and meets the conditions for participation in the procedure. The period of 2 months specified in section IV.2.6) shall be understood as 60 days from the fixed date for submission of tenders. The Awarding Entity does not provide for the possibility of awarding contracts referred to in art. 67 section 1 points 6 and 7 of the Act. The contractor is obliged to pay a deposit of PLN 30,000.00 (thirty thousand zlotys). The contractor is required to provide a security of due performance of the contract before signing the contract in the amount of 8% of the total gross price specified in the offer.

The contractor within 3 days from the date of posting on the purchasing platform the information referred to in art. 86 section 5 of the Act, is obliged to provide the contracting authority with a declaration of belonging or not belonging to the same capital group as referred to in art. 24 paragraph 1 point 23 of the Act. With the submission of the declaration, the contractor may provide evidence that the links with another contractor do not lead to a distortion of competition in the procurement procedure. A specimen declaration is attached as Annex 4 to the ToR. Deadline for the contract: the deadline for the service referred to in § 3 para. 1 point 1 of the material provisions of the contract is 25 business days from the date indicated in the written Order sent by the Employer to the Contractor at least 3 days in advance (calculated in business days); the deadline for performing the services referred to in § 3 para. 1 point 2,3,4, the parties agree on significant provisions of the contract for 36 months from the date of signing the service acceptance protocol without reservations, referred to in § 3 para. 1 point 1 Material provisions of the contract.
