Gasunie Deutschland GmbH & Co. KG (“GUD”) is a transmission system operator within the meaning of the Energy Industry Act (EnWG) and operates a pipeline network of approximately 4,300 km in length in Germany.
In the context of current applications in accordance with sections 33 and 39 of the GasNZV (see also the Gas 2020 Network Development Plan), new requirements from the Federal Immission Control Act and the current plans for a national hydrogen network in Germany, the GUD sees a high demand for the projects envisaged here, in the event of the implementation of the planned projects, supporting general planning and project management services. Due to the regulatory requirements and framework conditions for the implementation of such pipeline construction or plant projects, these projects must be implemented regularly within short periods of time. The preparation and planning of projects already takes up a considerable part of the project duration.
With regard to such projects, GUD pursues the strategy of outsourcing the necessary general planning and project management services and would like to establish the legal framework for commissioning suitable contractors at an early stage through a framework agreement. After the conclusion of a framework contract, a contractor is then commissioned after execution of a so-called “mini-tender” (tender for the specific project) on the basis of project assignments to be issued separately.
Since the specific type of large-scale building projects to be implemented cannot be foreseen when this framework contract is tendered, tenders for the project types “line construction projects” and “plant projects” will be tendered in the following different lots:
Lot 1: Pipeline construction projects are large-scale new construction of energy transport lines or major modifications of existing transport lines to meet future requirements (e.g. hydrogen) on existing networks. These projects can also explicitly include the creation or modification of associated stations for gas quality and volume measurement as well as valve locations.
Lot 2: Plant projects for the construction and modification of compressor stations.
Lot 3: Plant projects for the construction and modification of larger gas pressure control measuring systems (GDRM) and feed-in plants of biogas and/or hydrogen generation plants.
GUD pursues the goal of concluding up to three (3) framework contracts per lot in order to cover current and future requirements. The contract is therefore awarded to the three (3) most economical offers according to the evaluation matrix per lot. The minimum number of framework contracts to be concluded is two (2) framework contracts per lot. If the required minimum number of framework contracts is not concluded in a lot, the corresponding lot will be removed from the award procedure. A new award procedure is then carried out separately for the affected lot.
Within the framework contract holders, projects are awarded within the framework of a mini-tender process, in which the project-specific qualifications of the individual contract holders are checked. For this purpose, the award documents include the evaluation matrix for the mini-tender.
There is an increased risk that the planned projects will not be realized for reasons not attributable to the client, or will be interrupted in the further course of the project. It is due to this basis of the contract to be concluded that the contract may be terminated by the client without compensation at any time.
As a result, the estimated total may deviate significantly downwards. The client can imagine an estimated total value in the range of 20,000,000.00 EUR to 75,000,000.00 EUR.
