2. Procedure
The award procedure is divided into two stages.
a) Participation competition
In an upstream application process, companies express their interest in participating in the procedure and provide, among other things, the references mentioned in section "II.2.9". The exclusion, selection and eligibility criteria must be provided via the attached application for participation. All required / required supporting documents and self-declarations must be attached to the application. If an applicant is unable to provide only one explanation/proof of the exclusion criteria, he or she will be excluded from the procedure. The client only sees a subsequent demand for missing declarations or evidence in accordance with § 56 para. 2 VgV in
in the event that fewer than 5 applicants meet the eligibility requirements. According to § 51 VgV, the number of applicants for the second phase is limited. For this purpose, a ranking is established on the basis of the objectively and non-discriminatory eligibility criteria of the application for participation in the form of points achieved. The top 3-5 applicants will be invited to submit bids. In the case of legal entities, the technical requirements are fulfilled if their statutory business purpose includes planning services that correspond to the task at hand and if the authorized representative of the legal entity fulfils the professional requirements placed on natural persons. In the case of a consortium of applicants, all participants must meet the exclusion criteria separately. After reviewing the submitted documents, the maximum of five applicants with the highest scores will be invited to the negotiation interviews. In the case of applications with the same number of points, the decision will be made by lot in accordance with § 75 para. 6 VgV.
b) Negotiation talk
During the interview, the candidates personally introduce their office and the people involved in the process (office owners, project managers) and provide information about their working methods. References are presented in the negotiation meeting. The contract is awarded to the bid that achieves the highest overall point value, taking into account the award criteria. For award criteria 1, 2, 3 and 4, a minimum of 175 points must be achieved in order for the contracting authority to award the contract. The client reserves the right to award the contract to the initial offer in accordance with §17 (11) VgV. The language in which the conversations are conducted and in which the assignment must be executed is German. The area of approval is the European Union (EU) or the European Economic Area (EEA) and the Agreement on Government Procurement (GPA).
3. Assignment
As part of the VgV procedure, a company in the field of outdoor facility planning, as well as services for the use of the BIM methodology, is now to be determined. The contract is awarded depending on the project approval by the municipal council of the city of Stuttgart within the framework of call-off contracts. The contractor is obliged to take over the service up to and including service phase 9 in accordance with § 38 HOAI 2021 if the project comes to fruition. The client intends to commission the service phases in stages. There is no legal entitlement to the commissioning of all service phases. The client reserves the right to prescribe a specific legal form in accordance with § 43, paragraph 3 VgV after the contract has been awarded.
