m22tar3g23 Innovation partnership for the study, development, supply and maintenance in operational condition of third-generation diving breathing apparatus for military needs
this opinion concerns a defence or security contract for which the subject is set out in paragraph II.1.1. The sought-after equipment, a military rebreather for scuba diving, combines specificities (versatile ventral/back positioning, PPO2 adjustability, closed-circuit pure oxygen mode and extended autonomy) that no existing product has in its entirety. An innovation partnership is therefore passed according to a procedure with negotiation (articles L2324-3, R2324-3, R2361-8 to R2361-11 and R2372-17 to 18 of the Public Order Code). A
maximum of three partners can be selected and each will be awarded a composite framework agreement with firm share and share in subsequent contracts in accordance with articles L2325-1.1 and R2362-1 to R2362-7 of the Public Order Code, comprising three phases whose contents are described in section II.2.1 of this notice. At the end of each phase, each partner may be eliminated on the basis of the criteria and modalities defined in the framework agreement and consultation documents. A termination decision entails the termination of execution of the framework agreement for any eliminated partner.
The firm share covers phase 1. A maximum of two partners may be selected for Phase 2 under Subsequent Contract #1, followed by up to one partner for Phase 3 under Subsequent Contract #2. The latter will comprise a firm part and a part with purchase orders executed according to the provisions of article R2362-8 of the public order code and orders for supplies or services for possible technical hazards (articles R2372-19 to R2372-21 of the public order code).
Optional tranches may be considered in subsequent contracts (articles R2313-2, R2391-8 to R2391-10 of the Public Order Code).
