1. The subject of the contract is the development of documentation i.e. construction project, implementation projects, technical specifications for the performance and acceptance of construction works, objects of works and investor cost estimates together with all necessary opinions, consents, notifications, decisions formally-legal and other necessary to submit an application and obtain, on behalf of the Contracting Authority, final or having the rigor of immediate enforceability of decisions authorising the implementation of construction works (ZRID/PnB), broken down into 2 tasks:

2. The procedure is carried out in an unlimited tender procedure, pursuant to Article 132 of the Law of 11 September 2019 - Public Procurement Law (Journal of Laws 2019, item 2019, item 2019, hereinafter referred to as the “Pzp Act”).

1. Development of documentation, i.e. PB, PW, TSPACW, objects of works and investor cost estimates, together with the necessary opinions, consents, notifications, formal and other decisions necessary to submit the application and obtain final decisions permitting the implementation of construction works ( ZRID/PnB): Expansion of the section of the provincial road no. 776

Tasks no. 1 — Kocmyrzowska Street from the intersection with Bukszpanowa Street (from admin. 898 obr. 10 Nowa Huta and No. 513 obr. 11 Nowa Huta) to the boundaries of Krakow;

Task no. 2 — from the border of the city of Krakow to the extended section of the voivodeship road no. 776 in Prussia.

2. A detailed description of the subject matter of the contract and the scope of the Contractor's responsibilities are set out in the Annexes to the SWZ, including, inter alia, the Designed Contract Terms (PPU) and the Subject Description of the Order (OPZ).

3. The Contracting Authority shall, in accordance with Article 139 (1) of the Pzp Act, provide for an inverted order of activities, i.e. first to examine and evaluate tenders, and then to make the qualification of the Contractor whose offer has been the highest rated, in the absence of grounds for exclusion and fulfilment of the conditions participation in the proceedings. Due to the application of the above procedure, the Contracting Authority does not require the submission of a declaration in the form of a Single European Procurement Document (SOME) with the offer. The Contracting Authority shall request that this statement be made only from the Contractor whose offer has been rated at the highest.

5. The Contractor is obliged to carry out the object of the contract (task number 1 and task number 2) within 13 months from the date of conclusion of the contract. Detailed deadlines for the execution of the object of the contract are set out in §2 of the Designed Contract Provisions (Annex No 1 to SWZ).

6. The Contracting Authority provides for the award of contracts referred to in Article 214 (1) (7) of the Pzp Act, consistent with its subject matter, representing a repetition of the similar object of the contract, up to 50% of the estimated value of this contract. The Contracting Authority provides, within 3 years from the date of the award of the basic contract, the possible conclusion of contracts for similar services, and the determination of the Contractor's remuneration will occur after previous negotiations with the Contractor (prices may not exceed the average market prices in the given half year).

7. The Contracting Authority does not require that persons participating in the execution of the contract be employed by the Contractor or Subcontractor under an employment contract within the meaning of the provisions of the Act of 26 June 1974 — Labor Code.

8. The Contracting Authority shall not require the Contractors to submit the measures of evidence in question.

9. The Contractor shall, before the expiry of the deadline for the submission of tenders, contribute a defect of PLN 30,000 (in words: thirty thousand zlotys 00/100).

10. Prior to the conclusion of the contract, the Contractor whose offer was considered the most advantageous shall be obliged to provide a security for the sound performance of the contract amounting to 5% of the gross price (total) stated in the tender.

11. Information obligation arising from EP and Council Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals in connection with the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation ) — is described in Section XXII of the SWZ.

The Contracting Authority notes that, in view of the technical absence of the possibility to indicate in the contents of this announcement all the information on the subject of the order (too small number of characters possible to enter in each box of the form), this announcement contains references to the contents of the A specification of the Terms of Order (known as SWZ) posted on the website of the proceedings https://zimkrakow.ezamawiajacy.pl where there is a set of necessary information in this subject.
