The subject of the order is
• in the basic scope (Phase I) development of design documentation along with obtaining administrative decisions as part of the project "Supplementing the railway network with a railway connection between Jastrzębie-Zdrój and Katowice"
• within the scope of the Right of Option (Phase II), performing author's supervision during the duration and acceptance of construction works.

1. The object of the order is
• in the basic scope (Phase I) development of design documentation along with obtaining administrative decisions as part of the project "Supplementing the railway network with a railway connection between Jastrzębie-Zdrój and Katowice"
• within the scope of the Right of Option (Phase II), performing author's supervision during the duration and acceptance of construction works.
2. The exercise of the Option Right is the right of the Ordering Party and depends solely on its needs. Failure to exercise this right does not result in any claims on the part of the Contractor.
3. The contracting authority shall provide for the award of contracts referred to in Article 388(2)(c) of the Public Procurement Law. The scope of contracts and the conditions under which they will be awarded are determined by SWZ (TOM OPZ).
4. A similar contract may be awarded under the single-source procurement procedure, after prior negotiations with the Contractor and will be implemented on the terms set out in the basic agreement, in particular with regard to the terms of the contract, including price, deadline, warranty period/warranty period and may cover the following areas of industries covered by the basic contract:
- construction and construction;
- bridge;
-Road;
-Telecommunications;
- gas, heating, ventilation and sanitary networks;
- rail traffic control;
- railway engineering;
- electrical and power networks, installations and equipment;
-Architectural;
- the provision of services in the field of geodesy;
- the provision of services in the field of railway traffic engineering and transport organization;
- the provision of cost estimation services;
- the provision of transport analysis services;
- the provision of services in the field of railway traffic engineering and transport organisation;
- the provision of financial and economic services;
- the provision of environmental services;
- other.
Similar contracts referred to in Article 388(2)(c) of the PUBLIC PROCUREMENT LAW may be awarded in the case of:
- imposing by issued administrative decisions a change in the scope of investment,
- changes in the applicable law, internal instructions and instructions of the Management Board affecting the further implementation of the project.
