The subject of the contract is Performance of post-consolidation development works on the task,, Construction or reconstruction of agricultural transport roads, renovation of drainage ditches and land reclamation” for the project entitled.,, Merging the land of the village of Siennów gm. Zarzecze” within the framework of the action “Support for investment related to the development, modernisation and adaptation of agriculture and forestry “covered by the Rural Development Programme 2014-2020”.
1. The subject of the contract is Performance of post-consolidation development works on the task,, Construction or reconstruction of agricultural transport roads, renovation of drainage ditches and land reclamation” for the project entitled “Merging of the land of the village of Siennów gm. Zarzecze” within the framework of the action “Support for investment related to the development, modernisation and adaptation of agriculture and forestry “covered by the Rural Development Programme 2014-2020”.
2. The scope of works includes:
1) Construction or reconstruction of access roads to agricultural and forestry land and access to the buildings of individual participants of the merge.
2) Correction of mileage and improvement of technical parameters of water drainage equipment or other water equipment.
3) Elimination of unnecessary copper and roads and carrying out reclamation procedures enabling mechanical cultivation of land.
3. Detailed scope of works is clarified by the design documentation constituting Annex 1 to the SWZ.
4. Equivalent solutions:
1) If the design documentation or TSPACW, thus in the documents describing the subject of the contract, trademarks, patent or origin, sources or special process that characterizes the products or services provided by a particular contractor are indicated, and such references do not accompanied by the expression 'or equivalent', the Contracting Authority shall allow solutions equivalent to those described and the indication to be appended,, or equivalent”. The Contracting Authority shall not limit the applicability of equipment and equivalent materials by the Contractor, with parameters not inferior to those described in the documentation.
2) The Contracting Authority describing the subject matter of the contract by reference to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 (1) point 2 and paragraph 3 of the Pzp Act, in accordance with Article 101 (4) of the Pzp Act allows solutions equivalent to those described. In accordance with Article 101 (5) of the Pzp Act, where the description of the subject matter of the contract refers to standards, technical assessments and technical reference systems referred to in Article 101 (1) (2) and paragraph 3 of the Pzp Act, the Contractor who relies on equivalent solutions is obliged to prove in offer, in particular by means of the means of evidence referred to in Articles 104-107 of the Pzp Act, that the solutions proposed by him meet the requirements set out in the description of the subject of the contract to an equivalent extent. Pursuant to Article 101 (6) of the Pzp Act, where the description of the subject of the contract refers to the requirements for performance or functionality referred to in Article 101 (1) (1) of the Pzp Act, the Contractor who relies on equivalent solutions, provided that they comply with the standards ( Polish Standard transferring European standard, standards of other Member States of the European Economic Area transferring European standards, with European technical evaluation, with a common technical specification, with an international standard or with a technical reference system established by the European standardisation body) is required to prove in the offer, in particular by means of the means of evidence in question, as referred to in Articles 104-107 of the Pzp Act, that the building object, supply or service, fulfil the performance or functionality requirements laid down by The Ordering Party.
3) The Contracting Authority does not require the submission of the evidence in question, subject to the situation where the Contractor by means of them proves equivalence to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 (1) (2) and paragraph 3 of the Law of the Pzp Act and performance or functionality requirements referred to in Article 101 (1) point 1 of the Pzp Act, as described by the Ordering Party, in accordance with the above subsection 2.
5. The Contracting Authority provides for requirements related to the execution of the contract in the field of employment on the basis of the employment relationship, in the circumstances referred to in Article 95 of the Polish Law.
