1. The Contractor shall be entrusted with various civil engineering work on the Client's supply facilities or the facilities leased or operated by the Client for complete execution, including the ancillary services required for this purpose in the Client's "Supply Area North", in accordance with the framework agreement and its components.
2. The framework agreement exists with a contractor.
3. The civil engineering work is divided into (1.) services in the on-call service for incidents and (2.) services for regularly planned construction projects. In the event of a malfunction, the on-call service is intended to ensure the fastest possible deployment of a civil engineering crew, in particular outside regular working hours. The contractor must ensure that the standby column is at every conceivable location in the supply area within 60 minutes of the request at the latest. Incident rectification must be ensured continuously for more than 24 hours a day on all calendar days of each contract year (including Sundays and public holidays).
4. The timely execution of the commissioned civil engineering services and the immediate elimination of incidents are essential foundations of the framework agreement.
5. For both service areas, execution shall take place on the basis of individual call-offs in individual orders on the basis of the agreements made in this framework agreement and its components.
The subject of the invitation to tender is a framework agreement for civil engineering works (excavation and reinstallation including ancillary services) for supply lines (in particular drinking water, electricity and gas) in two lots:
Lot 1 (supply area north)
Lot 2 (supply area south)
Lot 1 concerns the supply area north (Hagen, Herdecke); Lot 2 the supply area south (Lüdenscheid, Schalksmühle, Wiblingwerde, Altena, Werdohl, Plettenberg, Herscheid, Meinerzhagen, Kierspe, Halver and Neuenrade). The area of the supply area north is about 15 x 16 km (= 240 km²), that of the supply area south 35 x 28 km (= 980 km²).
A framework agreement is concluded with one company per lot.
The civil engineering work includes work that can be planned as well as the elimination of incidents. The actual relocation or accident elimination work is generally carried out by ENERVIE Vernetzt GmbH itself or other external service providers.
Troubleshooting must be ensured 24 hours a day, every day (including Sundays and public holidays).
The timely execution of civil engineering services is an essential basis of the framework agreement.
Specific contracts based on the framework agreement shall be awarded on demand in each lot without a new award procedure.
The framework agreement shall have a duration of four years in each lot. It is extended by a further year, unless it is terminated by ENERVIE Vernetzt GmbH with a notice period of nine months to the end of the respective term, but no more than a total of eight years from the award of the contract (so-called maximum term).
It should be noted that the A45 motorway is closed near Lüdenscheid. The closure will continue for several years. Long-distance traffic will be diverted over a wide area. This results in considerable traffic disruptions in both supply areas.
