The subject of the contract is the sale and successive delivery to the Ordering Party of "standard" diesel oil (ON) intended for refueling vehicles and combustion equipment of the Ordering Party, meeting the requirements of the PN-EN 590:2022-08 standard and the requirements of the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (i.e. Journal of Laws of 2015, item 1680). The technical and chemical parameters of the supplied diesel fuel may not be worse than those specified in the above-mentioned standard and in Annex 3 to the Regulation. The scope of the subject of the contract includes the sale of 335,000 liters (estimated quantity) of diesel fuel along with its successive delivery to the Ordering Party.

The scope of the subject of the contract includes the sale of 335000 liters (estimated quantity) of diesel fuel with its successive delivery to the Ordering Party.The amount of diesel oil specified by the Ordering Party is an estimated quantity and may be reduced in connection with this, with the proviso that the Ordering Party guarantees the purchase of at least 90% of the total amount of diesel oil referred to above. Due to the Failure of the Ordering Party to realize the estimated amount of diesel fuel in full, subject to the guaranteed quantity, the Contractor shall not be entitled to compensation claims. Place of order execution:a)an above-ground tank with a capacity of 5000 liters, equipped with a dosing device, located in the ZGO in Zakurzewo near Grudziądz, b) an above-ground tank with a capacity of 5000 liters, equipped with a dosing device, located in the SUW in Grudziądz, at 79 Hallera Street. Requirements regarding the method of contract execution:a)Delivery ON will take place by transport of the Contractor,b)Delivery ON will take place by road tankers at the disposal of the Contractor, meeting the requirements set out in the paragraph of 19.08.2011. on the transport of dangerous goods (Journal of Laws of 2021, item 756, as amended) equipped with legalized equipment to measure the amount of fuel dropped into the Ordering Party's tank [for each individual delivery, the Contractor must provide a certified copy or original of the current certificate of legalization of the tank truck flow meter],c)Delivery on will be carried out in batches, at the expense and risk of the Contractor, according to the current needs of the Ordering Party (5-8 times a month) in an estimated average amount of 4 500 liters once, on the basis of a single order placed electronically to the Contractor. The Contractor shall carry out the unit delivery within 24 hours from the date of receipt of the contract, however, the Contractor is obliged to confirm the acceptance of the order each time. Placing orders and deliveries will take place on working days – i.e. from Monday to Friday from 7.00 a.m. to 2.00 p.m., excluding public holidays, d)For each of the one-off deliveries, the Contractor will be obliged to provide the manufacturer's quality certificate ON – the certificate should be associated with the proof of delivery or issue by placing the delivery or issue number on it, it should contain: number, the date of issue, the name of on, the name of the body issuing the quality certificate, the date of receipt of the ON and the results of the ON tests, e)The Ordering Party reserves the right to make a random inspection of the delivered ON in terms of quality and compliance with the provided quality certificate, by submitting a sample of ON for examination to an independent accredited laboratory,f)The order will be considered completed only when the ON is pumped into the Ordering Party's tank and confirms the quantity of ON by him, g) The proof of delivery of on will be the WZ document issued by the Contractor, in which the actual amount of fuel accepted into the above-ground fuel tank will be entered (by the Ordering Party's employee). The document will be signed by the Ordering Party's employee and the driver of the tank truck. The amount of fuel accepted entered and confirmed by the above-mentioned persons will be the basis for issuing a VAT invoice. Detailed terms of fuel collection, price and payment terms are discussed in the contract template, constituting Annex 5 to SWZ,h)The Ordering Party does not provide for prepayments or advance payments for the implementation of the subject of the contract.i)The offered price of the offer must include all costs related to delivery, including the cost of transporting fuel.
