The object of the contract is a comprehensive supply of electricity, including the sale of electricity and the provision of electricity distribution services to facilities owned by PGK in Płońsk Sp. z o.o. during the period of 36 months, i.e. from 01.01.2022 year to 31.12.2024 year in tariff groups:
• B23 — 10 energy intake points (PPE), including two sumers
• C11 — 25 points of conscription (PPE).
The Contracting Authority accepts an estimated amount of energy of 9,518,700.00 kWh. The amount of electricity given is an estimated quantity calculated with due care to determine the value of the contract, which does not reflect the real or declared use of electricity during the duration of the contract.
1.The object of the order is a comprehensive supply of electricity, including the sale of electricity and the provision of electricity distribution services to facilities owned by PGK in Płońsk Sp. z o.o. during the period of 36 months, i.e. from 01.01.2022 year to 31.12.2024 year in tariff groups:
• B23 — 10 energy intake points (PPE), including two sumers
• C11 — 25 points of conscription (PPE).
2. The subject of the contract includes comprehensive delivery within the meaning of Article 3 (30) of the Act of 10 April 1997 — Energy Law (i.e. Journal of Laws of 2021, item 716 as amended), carried out on the basis of the Comprehensive Agreement referred to in Article 5 (3) of the Act, the implementing provisions thereto Act, and in particular the Regulation of the Minister of Economy of May 4, 2007 on the detailed conditions of the operation of the electricity system (Journal of Laws 2007 No. 93, item 623 as amended), Price list for electricity seller, Tariff for energy distribution services Electrical Competent Distribution System Operator (OSD Tariff), Traffic and Operation of the Distribution Network (IRiESD) instructions and generally applicable legislation.
3. The summary of Energy Consumption Points, the description of the subject of the order, the estimated electricity demand and additional information shall be included in Annex 1 to the swz.
4. For PPE numbered 590243877040308866, due to the cogeneration and requirements of Energa Operator S.A. it is required to distribute contracts for the sales contract and distribution contract. The Contracting Authority holds a distribution agreement for this PPE.
5. The Ordering Party accepts an estimated amount of energy of 9,518 700,00 kWh. The amount of electricity given is an estimated quantity calculated with due care to determine the value of the contract, which does not reflect the real or declared use of electricity during the duration of the contract.
6. Actual billing for electricity and distribution will be carried out on the basis of current indications of measurement systems and the price proposed in the Contractor's offer. The billing invoices are supposed to include a total settlement for electricity and energy distribution.
7. The Contractor is obliged to hold, at the date of commencement of the service, a contract with the Distribution System Operator, to whose network the Ordering Party's facilities are connected, enabling the provision of a comprehensive service for the facilities covered by this contract.
8. Electricity purchased on the basis of the contract concluded will be consumed for the purposes of the final customer, which means that the Contracting Authority is not an energy company within the meaning of the Energy Law Act.
9. Electricity supplied must meet technical standards in accordance with the provisions of the Act of 10 April 1997, Energy Law and the Executive Regulations to that Act and Polish Standards.
10. In case of failure to comply with qualitative standards of service to the Contracting Authority at its written request, the right to bonify or discharge at the rates set out in the Regulation of the Minister of Energy of 6 March 2019 on detailed rules for the formation and calculation of tariffs and clearing in electricity trading (Journal of Laws of 2019, item 503 as amended) or in any legislation issued on quality standards of service.
