Sarastia Oy's Procurement Services requests your offer for construction machinery and equipment for rent without user, according to the tender documents. The acquisition is divided into subentities. Competition is carried out in the form of an open procedure with the basis of the selection of the overall economic affordability and the best price-quality ratio as a reference basis. The bidder may offer to one (1) or more subsets. A maximum of five (5) eligible bidders are selected for each subset. The selection takes place in the bidders' scoring order. If more bidders earn the same amount of points on their offer, the contracting entity shall conduct an impartial draw to select the winner. Draw is a custom accepted in case law. Intra-subsets offers or alternative offers shall not be accepted. Details of reference criteria and scoring are provided in the RFQ.

Framework agreements are fixed term, with a duration of four (4) years. The termination period for the contracting entity, supplier and subscribers shall be six (6) months. Individual leases between supplier and subscriber under the framework arrangement may be in place for longer than the stem framework agreement. Leases must comply with the content and edge terms of the actual framework agreement, and leases must never have lower terms than the framework agreement. The logic of supplier selection and the performance of the mini-competition contained in the framework arrangement are set out in the draft contract attached to the tender offer.

The procurement decision does not create a contractual relationship between the contracting entity and the selected suppliers, but rather the contract arises when the procurement decision has obtained the force of law or the market law has authorised the contract to be executed and both contracting parties have signed the contract. Subscribers committed to the contract shall enter into the contract immediately after the entry into force of the contract period or at the latest upon the completion of their existing corresponding contracts. During the contract period, it is possible to extend the contract as specified in Annex 1 to the draft agreement.

By its offer, the tenderer undertakes all the terms and conditions set out in the invitation to tender. The bidder does not have the right to impose its own terms on its offer. The contract does not contain a quantity obligation, minimum purchase/sale items, and the tenderer selected as a contract partner does not provide an exclusive right to provide products and pavelums under the contract. Offers contrary to the invitation to tender, late or otherwise substantially incorrect shall not be accepted.
