1. The subject of the contract is the purchase of PEF Broker services. The PEF platform is used to support and document the process of implementation by contracting authorities and contractors of public supplies in the phase after the award of the contract.
2. Detailed information on the description, scope and conditions of implementation of the subject of the contract is specified in Annex 6 to the SWZ – "Draft provisions of the contract that will be introduced into the content of the concluded contract", and in particular Annex 3 to the contract entitled "Description of the Subject of the Order (OPZ)".
1. The subject of the contract is the purchase of PEF Broker services. The PEF platform is used to support and document the process of implementation by contracting authorities and contractors of public supplies in the phase after the award of the contract.
2. Detailed information on the description, scope and conditions of implementation of the subject of the contract is specified in Annex 6 to the SWZ – "Draft provisions of the contract that will be introduced into the content of the concluded contract", and in particular Annex 3 to the contract entitled "Description of the Subject of the Order (OPZ)".
3. Additional requirements of the Ordering Party related to the implementation of the subject of the contract in the scope of employment of persons referred to in Article 95/Article 96(2)(2) of the Act:
3.1. The Contractor/subcontractor is obliged to employ a person to perform the function of the Contractor's Project Manager throughout the entire period of the contract on the basis of an employment contract (full-time – full-time – full-time) within the meaning of the provisions of the Act of 26 June 1974 – Labour Code.
3.2. Detailed regulations concerning: the method of verifying the employment of the above-mentioned person, the rights of the Contracting Authority in the scope of control of compliance by the contractor with the requirements related to the employment of the above-mentioned person and sanctions for failure to meet these requirements have been included in the Draft provisions of the contract, which will be introduced into the content of the contract constituting Annex 6 to the SWZ.
4. The Ordering Party reserves the right of option. The type and maximum value of the option, as well as the circumstances of exercising the option, are specified in the "Draft provisions of the contract that will be introduced into the content of the concluded contract" constituting Annex 6 to the SWZ.
5. Information on anticipated contracts referred to in points (7) and (8) of Article 214(1).
5.1. The contracting authority provides for the possibility of awarding contracts pursuant to Article 214(1)(7) of the Act within 3 years from the date of award of the basic contract. These contracts will consist in the repetition of services similar to those covered by this contract.
5.2. The orders referred to in point 5.1. will consist in repeating services consistent with the services constituting the subject of this contract under the terms of the contract for the basic order, subject to changes in the deadlines and unit prices of the services provided after negotiations. The value of the material scope of services referred to in point 5.1 shall not exceed 20% of the value of the basic contract
5.3. The contracts referred to in point 5.1 shall be awarded after a separate public procurement procedure under the single-source procurement procedure.
5.4. Orders referred to in point 5.1. shall be awarded in the event of a need to change the deadlines for the contract or increase the material scope of services being the subject of the contract.
