The subject of these proceedings are services consisting in collecting, transporting and disposing of fallen animals or parts thereof by own transport from the lanes of public roads, internal roads and municipal areas not developed by the City of Łódź in 2023. 4.2. The order has not been divided into parts. The contracting authority withdrew from dividing the contract into lots, due to the fact that the contract is a uniform whole and interconnections between individual scopes for technical, organizational and economic reasons. In the opinion of the Contracting Authority, it is not possible to divide the contract into parts, as this would lead to difficulties in the implementation of the subject of the contract. Failure to divide the contract into lots will not violate the principle of fair competition and will not limit the possibility of applying for the contract for smaller entities. Contractors belonging to SMEs will have no difficulty in implementing it as a whole.
4.3. Pursuant to Article 95 of the PPL, the Contracting Authority requires the Contractor or Subcontractor to employ persons on the basis of an employment contract performing the activities indicated by the Contracting Authority in the scope of contract performance, if the performance of these activities consists in performing work in the manner specified in Article 22 §1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2019, item 1040, as amended), i.e.: removal of fallen animals or their parts, transport and disposal, unless they are (will be) performed by a given person as part of his business activity, were performed by persons employed by the Contractor or subcontractor on the basis of an employment contract within the meaning of the Act – Labor Code (indicate activities that consist in performing work in the manner specified in Article 22 § 1 of the Labor Code).
The scope of work of persons performing the activities indicated by the Contracting Authority in the field of contract performance and the method of documenting the employment of these persons and the Ordering Party's rights to control the Contractor's compliance with the requirements and sanctions for non-compliance with them are specified in the description of the subject of the contract (Annex No. 1 to the SWZ) and in the contract template (Annex No. 6 to the SWZ).
