The subject of the contract is the provision of security control and access control services as well as the protection of persons and property for the benefit of Mazowiecki Port Lotniczy Warszawa-Modlin Sp. z o.o.A detailed description of the subject of the contract is included in Annex 1 to SWZ – Description of the subject of the contract (OPZ).
Pursuant to Article 22b of the Act of 22 August 1997 on the Protection of Persons and Property (i.e. Journal of Laws of 2021, item 1995) and taking into account the nature of the contract, the Contractor is obliged to perform the contract independently without the possibility of entrusting the performance of civil aviation security activities at airports to other entities.
1. The subject of the contract is the provision of security control and access control services as well as the protection of persons and property for the benefit of Mazowiecki Port Lotniczy Warszawa-Modlin Sp. z o.o.
2. As part of the above-mentioned subject, the Contractor will be obliged to:
2.1.carry out security checks in civil aviation, in particular as regards the screening of persons, vehicles, baggage, cargo, mail, on-board and airport supplies and access control. Security screening is understood as specified in national and international legal regulations, actions performed in relation to the passenger, his cabin baggage, checked baggage, cargo, mail and on-board supplies, airport supplies, persons who are not passengers and items carried by them, vehicle control, in order to determine the legal possibility of their admission to the security restricted area.
2.2.carry out access control by means of measures to prevent the entry of unauthorised persons or unauthorised vehicles or both unauthorised persons and unauthorised vehicles.
2.3. providing services for the protection of persons and property consisting in round-the-clock action aimed at ensuring the safety of life, health and personal integrity, as well as action to prevent crimes and misdemeanors against property, as well as counteracting the occurrence of damage resulting from these events and preventing unauthorized persons from entering the protected area, on the terms set out in the Act of 22 August 1997 on the protection of persons and property (i.e. Journal of Laws of 2021, item 2021, item 2.397). 1995 ) and in the Law of 3 July 2002. Aviation Law (i.e. Journal of Laws of 2021, item 1898, as amended) and in the contract.
2.4.The activities listed in points 2.1. - 2.3. must be performed on the basis of and in accordance with the applicable regulations on civil aviation security and internal regulations of the Ordering Party - this applies in particular to the Airport Security Program and the Airport Security Plan, as well as in accordance with the provisions on the protection of persons and property.
3. The Contractor shall:
1) train at their own expense all employees performing the security control service at the Warsaw Modlin Airport, in the operation of equipment used for security control, including ongoing tests and assessment of the efficiency of devices, the Contractor is obliged to immediately provide information about possible defects to the Ordering Party;
2) submit complete documentation necessary to obtain temporary identification cards of the Warsaw Modlin Airport for employees dedicated to the implementation of tasks at the Warsaw Modlin Airport and car passes for company vehicles, in accordance with the applicable Pass Instruction (Annex No. 16 to the SWZ) and the Price List of Non-Aviation Services and Additional Fees of the Ordering Party (Annex No. 14 to the SWZ) at least 30 days before the commencement of the contract (no the condition met will mean an obstacle to the implementation of the subject of the contract resulting from the fault of the Contractor);
2) before commencing the implementation of the contract, train at their own expense all employees of the Contractor performing tasks at the Warsaw Modlin Airport in the field of civil aviation security in accordance with the Annex to the Regulation of the Minister of Infrastructure of 26 July 2021 on the National Training Program in the field of civil aviation security (Journal of Laws of 2021, item 1526), taking into account the positions and activities performed on them.
4. Pursuant to Article 95(1) of the PPL Act, the Contracting Authority requires employment on the basis of an employment contract (in the manner specified in Article 22 § 1 of the Act of 26 June 1974, Journal of Laws of 2020, item 1320 – Labour Code) by a contractor or subcontractor of persons performing activities during the performance of the contract.
