1. The subject of the contract is the supply of electricity to the Employer's facilities.
2. The scope of the subject of the order is presented below:
- C11 tariff group - estimated demand in kWh - 27 855.55,
- C21 tariff group - estimated demand in kWh - 4 642 865.50,
- B21 tariff group - estimated demand in kWh - 954 584.75.
3. A detailed description of the subject of the contract is specified in the ToR part "Description of the subject of the contract" constituting Annex 7 to the ToR.
4. The Purchaser declares that the forecast electricity consumption is only an approximate value, which may change during the performance of the contract compared to forecasts and will depend only on actual needs.
5. The Awarding Entity informs that the procedure of switching electricity supplier is carried out once again.
6. The current seller of electricity for the Employer's facilities is Przedsiębiorstwo Energetyki Cieplnej "Legionowo" Sp. z o. o

6. The current seller of electricity for the Employer's facilities is Przedsiębiorstwo Energetyki Cieplnej "Legionowo" Sp. z o. o. in Legionowo under a contract concluded for a definite period from 1.7.2019 to 31.3.2020.
7. Electricity should meet technical standards in accordance with the provisions of the Energy Law of 10.4.1997 (Journal of Laws of 2019, item 755, as amended), as well as implementing regulations to this Act and Polish standards .
8. The Employer obliges the Contractor to perform activities resulting from the power of attorney, constituting Annex 5 to the draft contract, and in particular to notify the indicated distribution system operator for the implementation of the contract for the sale of electricity concluded with the Contractor, making declarations of will and determining all necessary information on behalf of the Ordering Party.
9. With reference to art. 144 section 1 point 1 of the Act, the Employer reserves the right to amend the provisions of the concluded contract in relation to the content of the offer, on the basis of which the Contractor was selected in the cases specified in § 5 Relevant provisions of the contract (Annex 8 to the ToR).
The Employer also allows the possibility of introducing appropriate changes in the amount of remuneration due to the Contractor, in accordance with art. 142 paragraph 5 items 1, 2 and 3 of the Act.
10. With reference to art. 144 of the Act, the parties agree that in the event of not increasing the financial expenditure plan, the Purchaser reserves the right not to implement part of the subject of the contract with a value of up to 80% of gross remuneration. The Contractor shall not be entitled to any financial and legal claims for failing to fulfill part of the contract.
