The subject of the Order is the implementation and launch of the Park & Ride System (ITS system) including the construction and adaptation of Park & Ride car parks along with the implementation of road, construction and technical infrastructure (including system infrastructure) along with its system, infrastructure, tariff and ticket connection with those operating in the city of Bydgoszcz systems in the following locations: West junction, Gdańsk Forest, Przylesie, Kujawska, and Grudziądz. The order is being implemented in stages in the design-build and include system, in particular the implementation of:

1) project documentation with obtaining administrative decisions required by law,

2) construction works related to the construction of parking lots,

3) the supply and assembly of equipment as well as works related to the implementation and commissioning of the system.

The detailed description, scope and terms of the contract are specified in: Description of the subject of the contract (OPZ), Functional and Utility Program (PFU), model offer form, contract template, constituting an attachment to the ToR.

The contracting authority does not reserve the obligation for the contractor to perform the placement and installation work in person, as part of a supply contract, in accordance with Article 36a section 2 point 2 of the Public Procurement Law

The contractor may entrust the performance of part of the contract to a subcontractor. The contracting authority requires the contractor to indicate in the EAT statement the parts of the contract which it intends to entrust to subcontractors (Part II section D EAT, including, if known, provide subcontractor companies) and its percentage value (Part IV section C point 10 EAT) . No contractor's statement in this respect will mean that the contractor intends to independently implement the entire contract. If the contractor intends to entrust the performance of part of the contract to subcontractors.

The Contractor is responsible for the acts or omissions of the persons with whom he performs the obligation, as well as the persons to whom he entrusts the performance of the obligation, as for his own conduct (Article 474 of the Civil Code).

The contracting authority envisages awarding the contractor the contracts referred to in art. 67 section 1 point 7 of the Public Procurement Law, in the scope of additional supplies, the purpose of which is the partial replacement of delivered products or installations or increasing current deliveries or extension of existing installations, if a change of contractor would oblige the contracting authority to purchase materials with other technical properties, which would cause technical incompatibility or disproportionately large technical difficulties in the use and maintenance of these products or installations.
