The subject of the order is "Comprehensive electricity supply including its sale and distribution to the facilities of the Międzyzdroje Commune, its organizational units in the period from 21.5.2020 to 20.5.2023". The contracting authority acts on its own behalf and on the basis of authorization granted, on behalf of the entities listed in Annex 7 to the ToR. Whenever the content of the ToR refers to the Employer's buildings or facilities, this also applies to the co-ordering facilities covered by these proceedings and specified in Annex 1 to the ToR. The contracting authority conducts the said tender procedure in accordance with art. 16 clause 1 of the Act. The contracting authority is entitled to conduct the tender procedure and award the contract on behalf of all of the above. entities. Purchaser and the abovementioned the entities will conclude separate contracts resulting from these proceedings for the award of a public contract in an open tender for a comprehensive supply of electricity.

A detailed description of the subject of the contract, including the location and description of the electricity collection points, is contained in the "List of Acceptances", which is Annex No. 1 to the ToR (also constituting Annex No. 1 to the contract). The electricity values indicated in Annex 1 to the ToR are estimates, which does not reflect the actual or declared use of electricity during the duration of the contract and in no case can be the basis for any claims on the part of the Contractor. The actual settlements will take place on the basis of the current indications of the metering and billing systems for the supply of electricity in accordance with the Contractor's offer, for the distribution of electricity will take place on the basis of fees arising from the tariff of the distribution system operator. The subject of the order will be implemented under the conditions specified in the Energy Law of April 10, 1997 (i.e. Journal of Laws of 2019, item 755, 730, 1435, 1495, 1517, 1520, 1524, 1556, 2166), and also in the tariff for electricity distribution services of the relevant distribution system operator (DSO tariff) and in the Instructions for the operation and distribution of the distribution network (IRiESD), which were approved by the President of the Energy Regulatory Office. The quality standards of the subject of the contract are set out in the Regulation of the Minister of Economy of 4 May 2007 on detailed conditions for the operation of the power system (Journal of Laws of 2007 No. 93, item 623). The operator of the distribution system for all of the Employer's collection points is Enea Operator Sp. z o. o. For the consumption points indicated in Annex 1 to the ToR, Orange Polska SA is the current seller of electricity. The contract was concluded on the basis of a tender procedure carried out in 2018 for a specified period until 20.5.2020.
