1. The subject of the contract is the purchase of a system for radiosurgery of the brain, head and neck along with the performance of all design works and construction and assembly works aimed at introducing and launching the medical equipment purchased as part of the procedure.

2. A detailed description of the subject of the contract specifying the requirements of the Ordering Party, the quantity and scope of construction works constituting an element of the subject of the contract is included in Annex 1A to the SWZ – Price Form, Annex 1B to the SWZ – Description of the Subject of the Order and in Annex 5 to the SWZ – Draft Agreement. By completing the items indicated in Annex 1B to the SWZ, the Contractor confirms compliance with the requirements specified by the Contracting Authority.

3. The subject of the contract must comply with the Act of 7 April 2022 on medical devices (i.e. Journal of Laws 2022.974 of 2022.05.09.), if the Ordering Party requires offering an assortment constituting a medical device.

3. The offered subject of the contract must be complete, with a high standard both in terms of quality and functionality, as well as free from material, construction and legal defects.

4. The offered object of the contract must be admitted to trading and use in accordance with applicable law.

5. The subject of the contract must comply with the Act of 7 April 2022 on medical devices (i.e. Journal of Laws 2022.974 of 2022.05.09.), if the Ordering Party requires offering an assortment constituting a medical device.

6. In all provisions of the SWZ and its annexes, in which the Ordering Party refers to standards, approvals, technical specifications or reference systems or trademarks, parameters or sources of origin (names of manufacturers or devices) are indicated, in accordance with Article 99(5) and Article 101(4) of the PPL Act, the Ordering Party shall allow equivalent solutions.

7. The Contracting Authority does not reserve the right to apply for a contract only by the Contractors referred to in Article 94 of the PPL Act.

8. Pursuant to Article 257(1), the Contracting Authority informs that it may cancel the procurement procedure if the public funds that the contracting authority intended to allocate to finance the contract have not been granted to it.

9. Term of the order - delivery of Medical Equipment will take place in accordance with the schedule presented below:

- delivery of medical equipment to the Contractor's Warehouse by 1 December 2023;

- carrying out the procedure of quantitative acceptance of Medical Equipment – acceptance must be carried out no later than 1 December 2023;

- transport of Medical Equipment from the Warehouse to the destination and assembly and commissioning of Medical Equipment, performance of all adaptation works and obtaining all necessary permits enabling the commencement of services using Medical Equipment within 120 days from the date of signing the contract.
