This tender is intended to cover the procurement needs of FMS Wertmanagement AöR (FMS-WM) and FMS Wertmanagement Service GmbH (FMS-SG) for legal advice services in German employment law. The tender is issued with the aim of concluding up to four (4) framework agreements with law firms separately for each company for a term of six (6) years each.
Legal advice covers in particular, but not exhaustively, the following aspects:
- Individual labour law in the field of drafting, interpreting and terminating employment and service contracts
- Collective labour law in the field of staff and works councils
- Personnel measures in connection with the processing order of FMS-WM
- Company pension scheme, partial retirement and early retirement
- Cross-company use of employees without justification of a joint operation
- Use of external personnel (e.g. temporary employment)
- Representation in labour court proceedings, e.g. before the labour courts in dismissal protection actions
