Each time, in all cases in which the Contracting Authority, describing the subject of the contract by reference to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 paragraph 1 point 2 and paragraph 3 of the Act, the Contracting Authority allows solutions equivalent to those described, if they allow to obtain features or parameters not worse than those mentioned. The above means that the contractor may apply the solutions described by

the Ordering Party "or equivalent". Pursuant to Article 101(5) of the Act, the Contractor who refers to solutions equivalent to those described by the Contracting Authority is obliged to demonstrate that the supplies offered by it meet the requirements specified by the Contracting Authority, provided that the Contractor proves in the tender, in particular by means of the evidence referred to in Articles 104-107 of the Act, that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent degree.
