The subject of the contract is: Road maintenance - Protection of events on the road

The service will consist of changing the organization of road traffic during events organized on public roads in Częstochowa in the years: 2019-2021.

The responsibilities of the Contractor include, among others:

a) Making changes to traffic organization only on request and within the deadlines set by MZDiT in Częstochowa, using own road signs and road safety devices based on the approved traffic organization design received from the Employer,

b) close cooperation with the Road Traffic Department of the Municipal Police Headquarters in Częstochowa - strict compliance with the Police instructions (notifying the representative of the Municipal Road and Transport Authority in Częstochowa about the situations),

c) providing round-the-clock roster during the performance of commissioned services without additional remuneration,

d) carrying out permanent maintenance of the marking during

3.2. The Employer specifies the following requirements regarding the employment by the Contractor or Subcontractor of persons performing the activities of the contract indicated by the Employer on the basis of an employment contract:

1) In the scope of application of art. 29 item 3a The Employer requires employment by the Contractor or Subcontractor, in the manner specified in art. 22 § 1 of the Act of 26.6.1974 - Labor Code of persons performing the following activities: related to the introduction of changes in the temporary organization of traffic

2) During the performance of the contract, the contracting authority is entitled to perform inspection activities against the contractor regarding the fulfillment by the contractor or subcontractor of the employment requirement under the employment contract of the persons performing the activities specified in point 1. The contracting authority is entitled in particular to:

a) request statements and documents regarding confirmation of compliance with the abovementioned requirements and assessing them,

b) demand explanations in case of doubts as to confirmation of compliance with the abovementioned requirements

c) carry out on-site inspections.

3) During the performance of the contract, the contractor will submit to the contracting authority the evidence indicated below to confirm the fulfillment of the employment requirement by the contractor or subcontractor of persons performing the activities specified in point 1 during the performance of the contract at the time specified in the call,

- declaration of the contractor or subcontractor about employment on the basis of an employment contract of persons performing activities to which the contracting authority refers. This statement should contain, in particular: the exact specification of the entity submitting the statement, the date of submitting the statement, an indication that the activities covered by the call are performed by persons employed under an employment contract together with an indication of the number of these persons, names and surnames of those persons, type of employment contract and dimension full-time position and signature of the person authorized to make the statement on behalf of the contractor or subcontractor;

- a copy of the contract (s) of the persons performing activities referred to in the aforementioned contract certified by the contractor or subcontractor as appropriate. declaration of the contractor or subcontractor (together with the document regulating the scope of duties, if drawn up). A copy of the contract (s) should be anonymized in a manner that ensures the protection of employees' personal data, in accordance with the provisions of the Act of 29.8.1997 on the protection of personal data (i.e. in particular without addresses, PESEL number of employees. The employment contract may also contain other data Each contract should be analyzed by the applicant in terms of the provisions of the Act of 29.8.1997 on the protection of personal data; the scope of anonymization of the contract must comply with the provisions of the above-mentioned Act.) The name of the employee is not subject to anonymization. Information such as: date of the contract, type of employment contract and full-time employment should be identifiable;

- certificate from the competent ZUS branch confirming the payment of social security and health insurance contributions by the contractor or subcontractor on the basis of employment contracts for the last accounting period,

- a copy of the proof confirming the employer's registration for insurance, certified by the contractor or subcontractor, certified as true to the original, anonymized in a manner ensuring protection of employees' personal data, in accordance with the provisions of the Act of 29.8.1997 on the protection of personal data. The employee's first and last name are not anonymous.

The contracting authority provides for a sanction in the form of the contractor's obligation to pay a contractual penalty due to a failure by the contractor or subcontractor to employ under the employment contract of persons performing the activities listed in point 1.
