1. The subject of the order is the delivery of medical apparatus in the framework of the task: “DiagnostykaPlus” — the purchase of medical equipment for the Multispecialistic Hospital District S.A. in Tarnowskie Góry — computed tomograph and X-ray apparatus with C arm.

2. The scope of the subject of the contract includes:

1) Part A: computed tomograph;

2) Part B: X-ray camera with C arm.

3. The detailed scope of the object of the contract, the description of the requirements of the Ordering Party for implementation and acceptance shall specify:

1) the description of the object of the order in the tender form — Annex 1 to the SWZ,

2) the proposed provisions of the contract — Annex 2 and 3 to the SWZ.

1. The subject of the order is the delivery of medical apparatus in the framework of the task: “DiagnostykaPlus” — the purchase of medical equipment for the Multipecialistic Hospital District S.A. in Tarnowskie Góra — computed tomograph.

2. The detailed scope of the object of the contract, the description of the requirements of the Ordering Party for implementation and acceptance shall specify:

1) the description of the item of the order in the tender form, Annex 1 to the SWZ;

2) the proposed provisions of the contract — Annex 2 to the SWZ.

3. The required guarantee period for the subject of the contract shall be in Part A: a minimum of 24 months from the date of signing of the final passing and receiving protocol without comments, excluding:

(a) a server for which the required warranty period is 36 months from the date of signing the final transfer and reception protocol without comments;

(b) a monitor for which the required warranty period is 60 months from the date of signing the final transfer and reception protocol without comments;

(c) hard drives for which the required warranty period is 36 months from the date of signing the final hand-to-receive protocol without comments.

4. The Contracting Authority shall request from the Contractor the following measures of evidence proving that the deliveries offered meet the requirements laid down by the Contracting Authority:

1) current documents for marketing and use on the territory of Poland in accordance with the Medical Devices Act of 20 May 2010 (i.e., OJ 2020.186, as amended) and other applicable law;

2) the manufacturer's declaration of conformity

3. CE certificate issued by the notified body;

4) documents confirming the fulfilment of the technical and performance parameters of the products offered:

(a) discharge from the product catalogue or/and company materials of the distributor or/and technical cards of the products;

b) the test result print for the offered server model.

5. The Contractor shall submit the evidence in question together with the offer.

6. If the Contractor has not submitted the measures of evidence in question or the measures in question are incomplete, the Contracting Authority shall call for submission or supplement them within the time limit set.

7. The call procedure referred to in paragraph 6 shall not apply if the evidence measure in question serves to confirm compliance with the characteristics or criteria set out in the description of the criteria for evaluation of tenders, or despite the submission of the proof measure in question, the offer is subject to rejection or there are indications annulment of proceedings.

8. The Contracting Authority may request clarification from the Contractors regarding the content of the evidence in question.

2. The detailed scope of the object of the contract, the description of the requirements of the Ordering Party for implementation and acceptance shall specify:

1) the description of the item of the order in the tender form, Annex 1 to the SWZ;

2) the proposed provisions of the contract — Annex 3 to the SWZ.

3. The required guarantee period for the subject of the contract shall be in Part B: a minimum of 24 months from the date of signing of the final passing and receiving protocol without comments.

4. The Contracting Authority shall request from the Contractor the following measures of evidence proving that the deliveries offered meet the requirements laid down by the Contracting Authority:

(b) documents proving that the main components of the RTG apparatus (lamp, generator, mechanics) were produced by the same manufacturer, the manufacturer's statement.

5. The Contractor shall submit the evidence in question together with the offer.

6. If the Contractor has not submitted the measures of evidence in question or the measures in question are incomplete, the Contracting Authority shall call for submission or supplement them within the time limit set.

7. The call procedure referred to in paragraph 6 shall not apply if the evidence measure in question serves to confirm compliance with the characteristics or criteria set out in the description of the criteria for evaluation of tenders, or despite the submission of the proof measure in question, the offer is subject to rejection or there are indications annulment of proceedings.
