a) in lot 1 of the order - up to 155 collection (measuring) points in the List of electricity collection points facilities of the Myszków commune, which is Annex 1 to the ToR,

b) in lot 2 of the contract - up to 43 collection (measuring) points in the List of electricity collection points structures of organizational units of the commune of Myszków and MDK, which is Annex 2 to the ToR,

c) in lot 3 of the order - up to 17 collection (measuring) points in the List of electricity collection points ZWiK Sp. z o. o. which is Annex 3 to the ToR,

d) in part 4 of the order - up to 44 collection (measuring) points in the List of electricity collection points facilities of organizational units and companies of the Myszków Commune, which constitutes Annex No. 4 to the ToR.

1) The contracting authority, as part of the ongoing public procurement procedure aimed at selecting an offer and concluding a contract for part 1 of the contract, acts on its own behalf and on its own behalf - i.e. on behalf of the Myszków Commune and on behalf of the Myszków Commune;

2) Estimated electricity demand in the period from 01/07/2020 to 30/06/2021 for electricity collection points, specified in Annex 1 to the ToR, is: 1 111 780 kWh, including:

a) in tariff group O11 - 955 809 kWh,

b) in the C12b tariff group - 12,148 kWh, including:

• Day - 3,906 kWh,

• Night - 8,242 kWh,

c) in tariff group C11 - 269 kWh,

d) in tariff group C21 - 143 518 kWh,

e) in the R tariff group - 36 kWh;

3) The Employer has concluded contracts for an indefinite period for the provision of electricity distribution services:

a) with Tauron Dystrybucja SA, Branch in Częstochowa, Al. Armii Krajowej 5, 42-201 Częstochowa - in tariff groups: O11, C11, C21, R,

b) with Tauron Dystrybucja SA, Branch in Będzin, ul. Małobądzka 141, 42-500 Będzin - in the C12b tariff group, and the concluded electricity sales contract with TAURON Sprzedaż Sp. z o. o

With its registered office in Kraków (30-417) ul. Łagiewnicka 60, which is valid until June 30, 2020.

The Contractor is obliged pursuant to the power of attorney - Annex 10 to the ToR, which will be granted by the Myszków Commune, to notify the abovementioned Distribution System Operators (DSO) to implement the new electricity sales contract for a customer connected to the distribution network of Tauron Dystrybucja SA and to carry out the procedure related to the change of electricity supplier;

4) The guaranteed, minimum scope of the order, which will definitely be fulfilled, constituting the basic order, is: 1 111 780 kWh, including:

a) in tariff group O11 - 955 809 kWh,

b) in the C12b tariff group - 12,148 kWh, including:

• Day - 3,906 kWh,

• Night - 8,242 kWh,

c) in tariff group C11 - 269 kWh,

d) in tariff group C21 - 143 518 kWh,

e) in the R tariff group - 36 kWh;

5) The Purchaser reserves that optionally, depending on his choice, he can increase the minimum scope of delivery by:

• Night - 824 kWh,

c) in tariff group C11 - 18 kWh

d) in tariff group C21 - 14 352 kWh;

6) The maximum scope of the order, taking into account the option right, is:

3) The above-mentioned organizational units of the Myszków Commune have concluded contracts for the indefinite period of time for the provision of electricity distribution services with Tauron Dystrybucja SA / Częstochowa and the concluded contract for the sale of electricity with TAURON Sprzedaż Sp. z o. o. based in Kraków, ul. Łagiewnicka 60, which is valid until June 30, 2020, except for those listed in the Annex No. 2 to the ToR:

- in point 5 point 2 "Playground ORLIK Primary School No. 6, ul. Lime No. 2 "

- in point 15 Komunalny Zakład Gospodarki Mieszkaniowej - items 1 to 19 - for these items, the Employer has concluded comprehensive contracts for the supply of energy. The Seller, on the basis of the power of attorney granted by the Employer, will terminate the comprehensive contracts, conduct their separation procedure and sign a contract for the distribution of electricity for these electricity consumption points.

The Contractor is obliged on the basis of a power of attorney to be granted by the Myszków Commune - attachment number 12 to the Terms of Reference - to notify the Distribution System Operator (DSO): Tauron Dystrybucja SA, o / Częstochowa for the implementation of the new electricity sales contract for customers connected to the network distribution of Tauron Dystrybucja SA, and carrying out the procedure related to the change of electricity supplier;

4) The guaranteed, minimum scope of the contract, which will definitely be completed, constituting the basic order is: 790 068 kWh, including:

a) in Greek tariff C11 - 339 492 kWh,

b) in Greek tariff C21 - 157 463 kWh,

c) in Greek tariff C22b - 238 250 kWh, including:

Okrzei 140, 42-300 Myszków (one-person company of the Myszków commune);

2) Estimated electricity demand in the period from 01/07/2020 to 30/06/2021 for the collection points specified in Annex 3 to the ToR, is: 2 742 100 kWh, including:

a) in tariff group C11 - 43 229 kWh,

b) in the C22b tariff group - 609 785 kWh, including:

• Day - 412 765 kWh,

• Night - 197 020 kWh,

c) in tariff group B23 - 2 089 086 kWh, including:

• morning peak - 351 737 kWh,

• afternoon peak - 242 036 kWh,

• peak other hours of the day - 1 495 313 kWh;

3) The above-mentioned company in the Commune of Myszków has concluded for an indefinite period contracts for the provision of electricity distribution services with Tauron Dystrybucja SA Branch in Częstochowa and a contract for the sale of electricity with TAURON Sprzedaż Sp. z o. o. with headquarters in Krakow (30-417), ul. Łagiewnicka 60, which is valid until June 30, 2020.

The Contractor is obliged on the basis of a power of attorney to be granted by the Myszków Commune - Annex 14 to the ToR - to be notified to the Distribution System Operator (DSO): Tauron Dystrybucja SA, Branch in Częstochowa, for the implementation of a new electricity sales contract for customers connected to the network distribution of Tauron Dystrybucja SA, and carrying out the procedure related to the change of electricity supplier;

4) The Employer for lot 3 of the contract does not envisage exercising the option right when purchasing electricity.

5) Detailed regulations regarding the sale of electricity by the Contractor to Zakład Wodociągów i Kanalizacji Sp. z o. o. were described in the model contract for the award of a public contract - part 3 of the contract, which constitutes Annex 13 to the ToR.

1) The Employer, as part of the ongoing public procurement procedure aimed at selecting an offer and concluding a contract for Part 4 of the contract, acts on behalf of and for the following organizational units and companies of the Myszków Commune:

a) Environmental Self-Help House, ul. Gałczyńskiego 6 i 7, 42-300 Myszków,

b) Environmental Self-Help House, ul. Millenium 19c, 42-300 Myszków,

c) Przedsiębiorstwo Usług Komunalnych SANIKO Sp. z o. o., ul. Prusa 70, 42-300 Myszków,

d) Myszkowskie Towarzystwo Budownictwa Społecznego Sp. z o. o., ul. Skłodowskiej 6c, 42-300 Myszków;

2) The estimated demand for electricity in the period from 01/07/2020 to 30/06/2021 for the collection points specified in Annex 4 to the ToR is: 112,600 kWh, including:

a) in tariff group O11 - 6,200 kWh,

b) in tariff group C11 - 49 180 kWh,

c) in the G11 tariff group - 53 420 kWh,

d) in the C12A tariff group - 3,800 kWh, including:

• peak - 1 700 kWh,

• off-peak - 2,100 kWh;

3) The above-mentioned organizational units and the company of the Commune of Myszków have concluded for an indefinite period contracts for the provision of electricity distribution services with Tauron Dystrybucja SA Branch in Częstochowa and a contract for the sale of electricity with TAURON Sprzedaż Sp. z o. o. with headquarters in Krakow (30-417), ul. Łagiewnicka 60, which is valid until June 30, 2020.

The Contractor is obliged on the basis of a power of attorney to be granted by the Myszków Commune - Annex 16 to the ToR - to be notified to the Distribution System Operator (DSO): Tauron Dystrybucja SA, Branch in Częstochowa, for the implementation of a new electricity sales contract for customers connected to the distribution network Tauron Dystrybucja SA, and to carry out the procedure related to the change of electricity seller;

4) The Awarding Entity for lot 4 of the contract does not foresee exercising the option right when purchasing electricity.

5) Detailed regulations regarding the sale of electricity by the Contractor to organizational units of the Commune of Myszków, Przedsiębiorstwo Usług Komunalnych SANIKO Sp. z o. o. and Myszkowski Towarzystwo Budownictwa Społecznego Sp. z o. o. have been described in the model contract for the award of a public contract - part 4 of the contract, which constitutes Annex 15 to the ToR.
