Description:
Provision of forest management services in the area of the Herby Forest District in 2023.

The subject of the contract are services in the field of forest management in accordance with the definition in Article 6 paragraph 1 point 1 of the Act of 28 September 1991 on forests (consolidated text: Journal of Laws of 2022, item 672 – "Forest Act") covering works in the field of forest breeding and protection, fire protection, harvesting and harvesting of wood to be performed in the area of the Herby Forest District in 2023. The place of implementation of the subject of the contract will be the administrative area of the Herby Forest District. The implementation of works included in the subject of the contract for individual Packages will take place in the forest area – appropriate for a given Package. The material scope of the contract includes the total quantities of works in the field of forest breeding and protection, fire protection, logging and skidding resulting from Annex 2 to the SWZ. The material scopes listed in the annexes included in Annex 2 are estimates.

Package I – forestry: Blachownia, Aleksandria, Hutki excluding services: mechanical fragmentation of wood residues and mechanical soil preparation

1. The subject of the contract are services in the field of forest management in accordance with the definition in Article 6(1)(1) of the Act of 28 September 1991 on forests (consolidated text: Journal of Laws of 2022, item 672 – "Act on Forests") including works in the field of forest breeding and protection, fire protection, harvesting and harvesting of wood to be performed in the Herby Forest District in 2023.

2. The material scope of the subject of the contract includes the total quantities of works in the field of forest breeding and protection, fire protection, harvesting and harvesting of wood resulting from Annex 2 to the SWZ, which consists of:

Incl. No. 2.1. – planned size of works; Incl. No. 2.2. - detailed size of works by groups of activities, activities and location; Incl. No 2.3.1 — Forestry characteristics for timber harvesting; Incl. No 2.3.2 — Forest harvesting assortment system; Incl. No 2.3.3. — Summary of distances and conditions of skidding wood; Incl. No 2.3.4. — list of items with additional difficulties in terms of acquisition and skidding; Incl. No 2.3.5. – list of items not made available for machine acquisition; Incl. No 2.3.6. – Information on the optimal technology of logging (potential); Incl. No. 2.4.1. - information on the nature of forest care (zones for mowing weeds); Appendix No. 2.4.2. - list of items not available for renewal made with the help of a planter; The material scopes listed in the annexes included in Annex 2 are estimates.

3. Quality standards relating to all essential features of the subject of the contract are specified in Annex 3 to the SWZ, which consists of:

Incl. No 3.1. "Description of the standard of forestry work technology" adopted by Decision No. 34 of the Director General of the State Forests of 12 May 2022 on the introduction of the "Description of the standard of forestry work technology" in organizational units of the State Forests together with the changes introduced by amending decisions;

Incl. No 3.2. Description of the standard of technology for the execution of forest works in the Regional Directorate of State Forests in Katowice adopted by Decision No. 70 of the Regional Director of State Forests in Katowice of 24.10.2022 amending Decision No. 62 of the Regional Director of State Forests of 21.09.2022 on the introduction of the regional "Description of the standard of technology for forest work" in the forest districts of the RDSF in Katowice.

Specific Annex no. 3.1. to SWZ and in Zał. No. 3.2. to the SWZ, a detailed description of the standard of technology for performing individual forest works (activities) is the basis for determining the quality requirements relating to the elements constituting the subject of the contract (Appendix No. 2 to the SWZ). If the activity described in the above-mentioned annexes is not provided for in the description of the subject of the contract (Annex No. 2 to the SWZ), then in this respect the provisions of Annex No. 3.1. to the SWZ and in Annex 3.2. to the SWZ do not apply.

4. Descriptions of activity codes describing individual forest works (activities) included in the subject of the contract are described in Annex 3 to the SWZ.

5. A description of the rules of the procedure for the acceptance of forest works is included in Annex 3 to the SWZ.

6. Pursuant to Article 95 of the Public Procurement Law, the Contracting Authority requires the Contractor or a subcontractor to employ persons performing activities in the scope of contract performance consisting in obtaining and skidding wood raw material, if the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 - Labour Code (consolidated text: Journal of Laws of 2020, item 1320, as amended. died.).

7. A full description of the subject of the contract is included in part 2 of the SWZ.

8. The contracting authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Public Procurement Law within 3 years from the date of award of the basic contract.

Package IV - support for PAD and 2 fire towers. (location of PAD - office of the Forest District Herby 04-179o and towers in forestry: Herby 04-132h and Łebki 08-118b).

According to the cost estimate - Appendix 1 to SWZ for package IV. In accordance with section IIR.2 of Annex 3.2 to the SWZ - Flat-rate work within the framework of PAD and observation points ( p. 149). The standard for this activity includes:

- duty of dispatchers of alarm and dispatch points (7 days a week at hours in accordance with the ordering party's instructions, from March to October – from the beginning to the end of the direct action with exclusions caused by the cancellation of duty), as well as observation of forest areas (regardless of the form of ownership) from fire alarms and immediate information about detected threats (in accordance with the instructions received) during the period of conduct by the Ordering Party direct action in forest fire protection (according to the arrangements specified by the Ordering Party, generally in the period from March 1 to October 31, 7 days a week), the need and hourly scope of observation on a given day is determined and transferred by the Forest District Alert and Dispatch Point (observation from the spot is generally carried out from 9.00 a.m. to sunset with shutdowns caused by the cancellation of duty hours);
