This procedure follows a first procedure declared without further action due to unsuccessful application of Article R2185-1 of the Public Procurement Code (reference of the initial notice: Opinion no. 23-131198 published in the BOAMP and Opinion no. 2023/s 184 575209 published in the OJEU on 25/09/2023).- the collection is ensured on the territory of 16 municipalities under the basic offer and 5 municipalities under the possible additional service (variant imposed). As a non-allotted market, the object does not allow the identification of separate services, since the sole object of the contract is the collection and transport of the different waste streams, using the same door-to-door procedure and using the same material and human resources. In addition, the contract concerns only part of the Grand Chalon territory, the rest of the collection being carried out by the management company and the SITOM of Chagny
This is a composite framework agreement corresponding to: - in part, an ordinary contract for recurring services remunerated by a global and fixed price. - for another party, to a framework agreement with single-awarded purchase orders concluded pursuant to Articles R2162-1 to 6 of the Public Order Code, for temporary services of collection of household waste and packaging on the perimeter of the control room and remunerated by application of a unit price. The Framework Agreement is executed as and when purchase orders are issued and is concluded without a minimum amount and with a maximum amount of 240,000 euro (s) HT over 4 years.- The response to the consultation includes the mandatory costing of the possible additional service (imposed variant), as follows: door-to-door collection of residual and similar household waste as well as packaging in 5 municipalities under the conditions defined in the Cahier Special Technical Clauses as well as additional door-to-door collection of residual and similar household waste in June, July and August.- Free variants are not allowed
