1.10 Model contract – Part I
The contractor selected by tender is obliged to:
1) installation and development of the site and construction facilities,
2) providing on their own electricity supply and supply of technological and food water, as well as the possibility of heating beverages and meals,
3) maintenance of construction facilities,
4) restoring the area to its original state in places not provided for works
investment and occupied during the works,
5) removal of collisions during implementation,
6) bringing the area to its original state with compensation for possible damage
users of properties occupied during the works,
7) preparation of a laudation report, which is to include: contracts with possible
subcontractors and further subcontractors, the protocol of transfer of the construction site,
acceptance protocols, a set of attestations, certificates and technical approvals for
built-in building materials, final acceptance protocol, statement
an authorized works manager on the performance of the task in accordance with the regulations,
as-built geodetic inventory and all necessary documents for
handing over the object for use,
8) taking into account the scope of tasks and collisions occurring in the other parts of the contract in the performance of works,
The contractor selected by tender is obliged to:

As part of the implementation of this part of the contract, the Contractor will be obliged to:

b) Execution of works on the basis of drawings alternative to the construction project, in accordance with the annexes to the SWZ.

Obligations of the Contractor:
Delivery should include: transport, insurance for transport, unloading, carrying and setting the subject of the order in the rooms indicated by the Ordering Party, as well as (if applicable) its installation and commissioning and, in the case of electronic equipment, also initial training.
The offered subject of the order must be brand new, in the first grade, undamaged, free from physical and legal defects, fully operational and functioning without any disturbances and reservations, devoid of rights and burdens of third parties, as well as complying with applicable standards and having the necessary certificates and approvals in accordance with applicable law, which will be forwarded to the Ordering Party before signing the acceptance protocol.
The Contractor shall deliver the subject of the contract complete with all cables, consumables, components, etc., necessary for its proper use, ready to be commissioned and used without additional expenditures and purchases.
The Contractor shall deliver the subject of the contract approved for marketing and use in EU countries.
The Contractor will be obliged to provide with the subject of the contract instruction manuals in Polish (if applicable).
The Contractor will be obliged to attach a guarantee card to each subject of the contract covered by the guarantee (if applicable).
The Contractor shall deliver the subject of the contract at its own expense.
All operating systems and programs included in the order are required to include media as well as installation and operating instructions and certificates confirming the Ordering Party's right to use the Software as part of this order (if applicable).
The Contractor shall provide the Ordering Party with access to driver updates via the website (if applicable).
The Contractor shall indicate the warranty period granted for the offered equipment (if applicable).
Warranty requirements: the minimum warranty period required by the Ordering Party is counted from the date of signing the acceptance protocol,
During the warranty period (within the unit prices offered). The Contractor will be obliged to provide possible periodic inspections (the date of inspection must be agreed with the Ordering Party each time), if they are required by the manufacturer of the equipment and perform repairs at the Ordering Party's headquarters or replace it with a new one, free from defects - in the event of damage caused by material defects, workmanship or other hidden defects, within no more than 5 days from the date of notification by phone / fax / e-mail.
The contractor selected through a tender is obliged to draw up a laudation report, which is to include: contracts with possible subcontractors and further subcontractors, protocols for the acceptance of works, a set of attestations, certificates and approvals.
