The subject of the contract is the provision of services including the performance of investment substitution activities for the task entitled: "Modernization (including reconstruction) of the "Nowe Miasto" Sports Stadium at 1a Chopina Street in Wałbrzych – stage I" and conducting the settlement of the task.

The detailed scope of duties of the Substitute Investor can be found in the draft provisions of the agreement (draft agreement).

The duties of the Substitute Investor will include, m.in:

1) Administration of contracts concluded by the Contracting Authority with the Contractors of Works on the Task.

2) Cooperation with the Contracting Authority in implementing agreements concluded by the Contracting Authority with the Co-financing Institutions of the Task.

3) Fulfilling, in the place of the contracting authority, all obligations resulting from the implementation of the task, specified in the provisions of Polish law, in particular Pb with executive acts.

4) Representing the contracting authority during the performance of the contract before authorities, offices, courts, task partners and other institutions, including performing the activities provided for in Pb related to obtaining the required permits, decisions, notifications, opinions and approvals.

5) Performing full-discipline investor supervision in accordance with Article 25 of the PB:

(a) representation of the Contracting Authority on the construction site by checking compliance with its implementation with the design and construction permit, regulations and technical knowledge rules,

(b) verifying the quality of works and built-in construction products and, in particular, preventing the use of construction products defective and not authorised for use in construction,

(c) checking and acceptance of works that are covered or disappearing, participating in tests and acceptances of technical installations, technical equipment and preparing and participating in the activities of the final receipt of Works and carrying out all the activities related to the transfer of them for use,

(d) confirming the works actually performed and the removal of defects, as well as controlling the financial settlements of the Works,

(e) issue to the construction manager and/or the managers of works commands, confirmed by an entry in the construction log, concerning: removal of irregularities or hazards, execution of tests or tests, also requiring the discovery of the Works or the elements covered and the presentation of expertise concerning Works carried out and evidence of admission for use in construction of construction products and technical equipment,

(f) request from the construction manager and/or the managers of works to make amendments or re-execute defectively executed Works, and to request a halt to further Works in the event that their continuation could cause a threat or cause unacceptable incompatibility with the project or construction permit.

6) Cooperation with Designers in the framework of their copyright supervision.

7) Keeping records of outlays and clearing Tasks.

8) Performing the duties of a substitute investor in the period preceding the construction project.

9) Performing the duties of a substitute investor during the construction period.

10) Performing the duties of a substitute investor related to the acceptance of works and commissioning.

11) Performing the duties of a substitute investor during the warranty period for defects, resulting from contracts concluded by the contracting authority with contractors.

12) Performing the duties of a substitute investor in the scope of financial service of the task and resulting from agreements concluded by the contracting authority with institutions co-financing the task.

13) Cooperation with the contracting authority in the possible investigation and enforcement of damages or contractual penalties from the participants participating in the implementation of the task for improper or untimely performance of contractual obligations and representing the contracting authority in any disputes in order to defend the interests of the contracting authority.
