Description:

The subject of the contract is the preparation of design documentation and construction works for the construction of the Boguszów bypass in the Boguszów-Gorce commune and the construction of the Sobięcin bypass in the Wałbrzych commune.

The scope of the subject of the contract includes the preparation of project documentation, obtaining on behalf of the Employer the necessary decisions and arrangements, performance of construction works together with the services and accompanying works necessary for the proper performance of the contract, as well as obtaining by the Contractor a decision on the occupancy permit and / or effective submission by the Contractor and acceptance by competent authority of the notice of completion of construction for which no objection has been raised by decision.

The subject of the order was divided into two tasks.

Task 1

Preparation of design documentation and execution of construction works for the construction of the Boguszów bypass in the Boguszów-Gorce commune and construction of the Sobięcin bypass in the Wałbrzych commune - stage II and stage III on the section from km approx. 4 + 247 to km 5 + 125 in the commune of Boguszów-Gorce and on the section from km 5 + 125 (border of the city of Wałbrzych) to km 7 + 105 (street II Armii) in the commune of Wałbrzych.

1. The scope of the subject of the contract includes the preparation of project documentation, obtaining on behalf of the Employer the necessary decisions and arrangements, performance of construction works together with the services and accompanying works necessary for the proper performance of the contract, as well as obtaining by the Contractor of the permit to use and / or effective submission by the Contractor and acceptance by the competent authority of the notification

On the completion of construction for which no objection was raised by decision.

2. The subject of the contract shall be performed in accordance with the following documents:

1) the Specification of the Essential Terms of the Order (SIWZ),

2) Functional and Utility Program: Improving the safety and capacity of traffic along the "Sudecka Route" through the construction of the Boguszów bypass in the Boguszów-Gorce commune and the construction of the Sobięcin bypass in the Wałbrzych commune (annex No. 9a),

3) By decision of the Regional Director for Environmental Protection in Wrocław of February 28, 2017 on environmental conditions for project No. WOOŚ.4210.23.2015.KC.54 referred to in item 2) - (Annex No. 10), and by Decision The General Director for Environmental Protection in Warsaw of November 16, 2017 No. DOOŚ-DŚL.4210.12.2017.AS.5 - (Annex No. 11).

3. The complete set of project documentation developed as part of the contract shall include, in particular:

1) Construction project - 8 copies,

2) Executive design - 6 copies,

3) Technical specification of execution and acceptance of construction works - 6 copies,

4) A set of documentation in an electronic version (PDF files) - 6 sets (the electronic version will be the same as the paper version).

4. In order to obtain the necessary arrangements and / or permits and / or administrative decisions, the Employer allows the development, subject to compliance with the description of the subject of the contract included in the Functional Program, design documentation and technical specifications for the performance and acceptance of construction works broken down into sections. The Employer also allows the implementation of construction works broken down into sections, after agreeing with the Employer.

5. The contractor will be obliged to implement the subject of the contract in accordance with

With applicable regulations, in particular in accordance with:

1) the Act of 14 December 2012 on waste (Journal of Laws of 2018, item 21),

2) the Act of 27 April 2001 - Environmental Protection Law (Journal of Laws of 2017, item 519, as amended),

3) the Act of July 7, 1994 - Construction Law (Journal of Laws of 2018, item 1202),

4) the Act of 29 January 2004 - Public Procurement Law (Journal of Laws of 2018, item 1998, as amended),

5) the ordinance of the Minister of the Environment of December 31, 2014 on the template of documents used for the needs of waste records (Journal of Laws of 2014, item 1973),

6) the ordinance of the Minister of the Environment of December 29, 2014 regarding the waste catalog (Journal of Laws of 2014, item 1923).

6. All obligations and requirements related to the performance of the subject of the contract are contained in the contract template constituting the attachment to the ToR (Annex No. 5a), and

In other documents being part of the ToR.

7. Important provisions regarding employment under an employment contract are included in the model contract (Annex 5a to the ToR).

Exercise 2

Preparation of design documentation and execution of construction works for the construction of the Boguszów bypass in the Boguszów-Gorce commune and construction of the Sobięcin bypass in the Wałbrzych commune - stage II and stage III on the section within the Boguszów-Gorce commune from ul. Pułaskiego (0 + 000 km) to ul. Wałbrzyska (around km 4 + 247) to the connection point with the section implemented in task 1.

On the completion of construction for which no objection was raised by decision.

2. The subject of the contract shall be performed in accordance with the following documents:

1) the Specification of the Essential Terms of the Order (SIWZ),

2) Functional and Utility Program entitled: Improvement of safety and traffic capacity along the "Sudecka Route" through the construction of the Boguszów bypass in the Boguszów-Gorce commune and the construction of the Sobięcin bypass in the Wałbrzych commune (annex No. 9b),
