The subject of the contract are successive deliveries of fresh vegetables and fruits to the Police School in Piła in an approximate amount of 75 660 kg.

A detailed description of the subject of the contract and a full list of the assortment being the subject of deliveries and the maximum number of ordered products are given in the Assortment and Quantity Specification, which constitutes Annex 2 to the SWZ. That annex forms part of the tender and must therefore be submitted in accordance with the form prescribed for the tender. The quantities given are estimates and do not oblige the Ordering Party to purchase products in these quantities.

The Ordering Party reserves the right not to complete the subject of the contract with a value of up to 50% of the total gross remuneration. For non-performance of part of the contract, the Contractor is not entitled to any financial or legal claims.

The order will be executed successively: from the date of signing the contract until 31 December 2023 or until the total gross remuneration resulting from the contract is exhausted. Planned date of commencement of the contract: not earlier than from 1 June 2023 With reference to Article 455(1)(1) of the Act, the Contracting Authority reserves the right to extend the deadline for the performance of the contract to 2 months after the date specified in the contract, within the financial resources specified for this purpose and request the conclusion of an annex to the contract in this respect, if the funds resulting from the concluded contract are not exhausted within the prescribed period and the Contractor has not yet been selected as a result of another procedure.

Deliveries of goods will take place 5 times a week from Monday to Friday from 06:00 to 08:00 at the expense and risk of the Contractor. In justified cases, the Ordering Party may require the Contractor to make deliveries also on Saturdays from 06:00 to 08:00. Delivery, unloading and bringing in the subject of the contract will be carried out at the expense of the Contractor included in the price of products covered by the public procurement contract.
