Removal of vehicles from roads, residential zones, traffic zones located

in the city of Grudziądz and running a round-the-clock guarded car park for parking removed vehicles

Part I - Tasks carried out by the Contractor in particular include the removal of the following vehicles:

(a) bicycles and mopeds

(b) motorcycles

c) vehicles with a GVW of up to 3.5 t

d) electric scooters and personal transport devices

To perform the task, the Contractor should have at least one vehicle designed for towing and transporting vehicles with a maximum permissible weight of up to 3.5 t.

Before signing the contract, the Contractor, whose offer will be selected as the most advantageous, is obliged to submit to the Ordering Party a document confirming the Disposal by the Contractor of the vehicle j.w.

1) Removal of the above vehicles from roads, confusion zones and traffic zones on the basis of the instructions of authorized entities - in accordance with article 50a (1) and (130a) and (2) of the Act of 20 June 1997 - Road Traffic Law (i.e. Journal of Laws of 2022, item 988, as amended) and the Regulation of the Minister of Internal Affairs and Administration of 22 June 2011 on the removal of vehicles left without license plates or whose condition indicates it, that they are not used (Journal of Laws of 2011, No. 143, item 845, as amended), Regulation of the Minister of Internal Affairs and Administration of 22 June 2011.

on the removal of vehicles the use of which may endanger road safety or order or hinder the conduct of rescue operations (Dz. U.

of 2011, No. 143, item 846, as amended).

2) Cooperation with entities authorized to issue instructions to remove vehicles from roads, residential zones, traffic zones in the city of Grudziądz.

3) Safe transport of vehicles to the parking lot designated by the Ordering Party, including:

a) access to the vehicle being the subject of the notification,

b) preparation of photographic documentation allowing to determine possible damage to the vehicle before loading,

c) loading the vehicle, protection against damage, destruction, theft

during transport,

d) removing (taking) all elements of the vehicle from the road,

e) movement to a designated car park,

f) unloading the vehicle in the parking lot,

g) proper positioning of the vehicle in the parking lot,

(h) the protocol handover of the vehicle.

4) Provision of services in a continuous manner, in a 24-hour system, 7 days a week, with the provision of round-the-clock telephone communication.

5) After performing the vehicle removal service, sending the Ordering Party a photocopy of the correctly issued instruction pursuant to Article 50a or Article 130a of the Road Traffic Law to the e-mail address of the zdm@zdm.grudziadz.pl and sending information about the vehicle with its type, date and time of detention for a guarded parking lot and the registration number of the vehicle, permissible total weight, within 48 hours from the moment of taking the action of removing the vehicle.

6) Collecting from the owners of the removed vehicles in the name and on behalf of the Ordering Party fees for towing to a guarded car park in cases where the removal took place pursuant to Article 50a(1) and Article 130a(1) and (2) of the Act, according to the applicable rates specified in the Resolution of the Grudziądz City Council.

7) Keeping by the Contractor for the fees referred to in point 6 accounting and financial records, in accordance with applicable regulations in this respect.

8) Keeping records of vehicles towed to a guarded car park.

9) Keeping records for vehicles removed from the road pursuant to Article 130a of the Act and vehicles removed pursuant to Article 50a of the Act.

10) Transfer of fees collected on a given day to the Ordering Party's bank account No. 38 1020 5011 0000 9102 0169 6095 within 2 working days from the moment of receipt of the fee for towing the vehicle to a guarded parking lot from the owners of the removed vehicles.

11) To confirm the performance of activities under the contract, collective lists of vehicles towed for the current settlement period should be delivered to the Municipal Roads Authority in Grudziądz by the 5th day of the following month, specifying the fees referred to in paragraph 6 for the service, along with instructions to remove vehicles, acceptance protocols and PR

PART II

The tasks carried out by the Contractor in particular include the removal of the following vehicles:

a) vehicles with a GVW of more than 3.5 t to 7.5 t

b) vehicles with a GVW of more than 7.5 t to 16 t

(c) vehicles with a GVW of more than 16 t

(d) vehicles transporting dangerous goods

To perform the task, the Contractor should have at least one vehicle intended for towing and transporting vehicles with a permissible total weight of over 3.5 t to 7.5 t, one vehicle intended for towing and transporting vehicles with a permissible total weight of over 7.5 t to 16 t and one vehicle intended for towing and transporting vehicles with a permissible total weight of over 16 t.

Before signing the contract, the Contractor, whose offer will be selected as the most advantageous, is obliged to submit to the Ordering Party a document confirming that the Contractor has disposed of vehicles j.w.

1) Removal of the above vehicles from roads, confusion zones and traffic zones on the basis of the instructions of authorized entities - in accordance with Article 50a(1) and (130a)(1) and (2) of the Act of 20 June 1997 - Road Traffic Law (i.e. Journal of Laws of 2022, item 988, as amended) and the Regulation of the Minister of Internal Affairs and Administration

of 22 June 2011 on the removal of vehicles left without registration plates or whose condition indicates that they are not in use (Oj 2011,

No. 143, item 845, as amended), Regulation of the Minister of Internal Affairs

and the Administration of 22 June 2011 on the removal of vehicles whose use may endanger road safety or order or hinder the conduct of a rescue operation (Journal of Laws of 2011, No. 143, item 846, as amended).

2) Cooperation with entities authorized to issue instructions to remove vehicles from roads, residential zones, traffic zones in the city of Grudziądz.

e) movement to a designated car park,

f) unloading the vehicle in the parking lot,

g) proper positioning of the vehicle in the parking lot.

(h) the protocol handover of the vehicle.

4) Provision of services in a continuous manner, in a 24-hour system, 7 days a week, with the provision of round-the-clock telephone communication.

5) After performing the vehicle removal service, sending the Ordering Party a photocopy of a properly issued instruction pursuant to Article 50a or Article 130a of the Law Act

about traffic to the e-mail address of the zdm@zdm.grudziadz.pl and sending information

about the vehicle with its type, date and time of placing on guarded parking and the registration number of the vehicle, the permissible total weight, within 48 hours from the moment of taking action to remove the vehicle.

6) Collecting from the owners of the removed vehicles in the name and on behalf of the Ordering Party fees for towing to a guarded car park in cases where the removal took place pursuant to Article 50a(1) and Article 130a(1) and (2) of the Act, according to the applicable rates specified in the Resolution of the Grudziądz City Council.

7) Keeping by the Contractor for the fees referred to in point 6 accounting and financial records, in accordance with applicable regulations in this respect.

8) Keeping records of vehicles towed to a guarded car park.

9) Keeping records for vehicles removed from the road pursuant to Article 130a of the Act and vehicles removed pursuant to Article 50a of the Act.

10) Transfer of fees collected on a given day to the Ordering Party's bank account No. 38 1020 5011 0000 9102 0169 6095 within 2 working days from the moment of receipt of the fee for towing the vehicle to a guarded parking lot from the owners of the removed vehicles.

11) To confirm the performance of actions under the contract,

Part III

The tasks carried out by the Contractor include, in particular, running a round-the-clock guarded car park for parking removed vehicles, in particular:

(a) bicycles and mopeds

(b) motorcycles

c) vehicles with a GVW of up to 3.5 t

d) vehicles with a GVW of more than 3.5 t to 7.5 t

e) vehicles with a GVW of more than 7.5 t to 16 t

(f) vehicles with a GVW of more than 16 t

g) electric scooter and personal transport devices

1. Running a round-the-clock guarded car park for parking vehicles removed from the city of Grudziądz, including:

a) securing vehicles and things stored in it against damage, theft, devastation (the Contractor will prepare accurate photo documentation),

b) providing assistance to experts in the performance of visual inspection,

c) notifying the Municipal Roads Authority in Grudziądz and the entity that issued the instruction to remove the vehicle no later than on the third day from the date of expiry of this period, about not picking up the vehicle from the parking lot within the period specified in Article 50a paragraph 2 of the Act,

d) notifying the Municipal Roads Authority in Grudziądz and the entity that issued the instruction to remove the vehicle, no later than on the third day from the date of expiry of this period, about the failure to collect the vehicle from the parking lot within the period specified in Article 130a paragraph 10 of the Act,

(e) issuing to the owner of the detained vehicle on the basis of a permit issued by the authority:

• municipalities – in the case of removal of the vehicle in the manner specified in Article 50a(1) of the Act

• issuing an instruction to remove the vehicle - in the case of removal of the vehicle in the manner specified in Article 130a paragraph 1 of the Act.

2. Provision of services continuously, in a 24-hour system, 7 days a week, with the provision of round-the-clock telephone communication.

3. Informing the Ordering Party within 48 hours about the acceptance of the vehicle to the Contractor's parking lot via e-mail to the following address: zdm@zdm.grudziadz.pl.

4. Collecting from the owners of the removed vehicles in the name and on behalf of the Ordering Party fees for parking the vehicle in a guarded car park in cases where the removal took place pursuant to Article 50a(1) and Article 130a(1) and (2) of the Act, according to the applicable rates specified in the Resolution of the Grudziądz City Council.

5. Keeping by the Contractor for the fees referred to in point 4 accounting and financial records, in accordance with applicable regulations in this respect.

6. Keeping records of vehicles accepted into a guarded car park, which were collected by the owners and not collected within the statutory period.

7. Keeping records for vehicles removed from the road pursuant to Article 130a of the Act and vehicles removed pursuant to Article 50a of the Act.

8. Keeping a register of vehicles received and issued containing:

(a) the date and time of acceptance and delivery of the vehicle,

b) the date and number of the permit to collect the vehicle from the guarded car park,

9. Transfer of fees collected on a given day to the Ordering Party's bank account No. 38 1020 5011 0000 9102 0169 6095 within 2 working days from the moment of receipt of the fee for parking the vehicle in a guarded parking lot from the owners of the removed vehicles.

10. Delivery to the Ordering Party as confirmation of the performance of the resulting activities

from the contract, collective lists of vehicles stored and collected for the current settlement period, specifying the fees referred to in paragraph 4 for the service together with a register of accepted and issued vehicles and with copies of proof of payment – by the 5th day of the following month.

11. Proper safeguarding of funds collected from vehicle owners.

12. Securing information and personal data collected against access by unauthorized persons.

13. Preservation of data to which the Contractor has gained access as part of the performed contract.

14. Acceptance of full civil and legal liability for parking and storage of vehicles, their parts and other things during the provision of the service.

15. Preparation of a protocol of handing over the vehicle to the vehicle dismantling station indicated by the Ordering Party for the entity selected by the Ordering Party to provide vehicle removal services,

Part IV

The tasks carried out by the Contractor in particular include running a round-the-clock guarded car park for parking removed vehicles in accordance with the Regulation of the Minister of Internal Affairs of 13 November 2012 on the technical conditions of car parks to which vehicles transporting dangerous goods are removed (Journal of Laws of 2012, item 1293), in particular:

(a) vehicles transporting dangerous goods

1) Running a round-the-clock guarded car park for parking vehicles removed from the city of Grudziądz, including:

a) securing vehicles and things stored in it against damage, theft, devastation (the Contractor will prepare accurate photo documentation),

b) providing assistance to experts in the performance of visual inspection,

c) notifying the Municipal Roads Authority in Grudziądz and the entity that issued the instruction to remove the vehicle no later than on the third day from the date of expiry of this period, about not picking up the vehicle from the parking lot within the period specified in Article 50a paragraph 2 of the Act,

d) notifying the Municipal Roads Authority in Grudziądz and the entity that issued the instruction to remove the vehicle, no later than on the third day from the date of expiry of this period, about the failure to collect the vehicle from the parking lot within the period specified in Article 130a paragraph 10 of the Act,

(e) issuing to the owner of the detained vehicle on the basis of a permit issued by the authority:

• municipalities – in the case of removal of the vehicle in the manner specified in Article 50a(1) of the Act

• issuing an instruction to remove the vehicle - in the case of removal of the vehicle in the manner specified in Article 130a paragraph 1 of the Act.

2) Provision of services in a continuous manner, in a 24-hour system, 7 days a week, with the provision of round-the-clock telephone communication.

3) Informing the Ordering Party within 48 hours about the acceptance of the vehicle to the Contractor's parking lot via e-mail to the following address: zdm@zdm.grudziadz.pl.

4) Collecting from the owners of the removed vehicles in the name and on behalf of the Ordering Party fees for parking the vehicle in a guarded car park in cases where the removal took place pursuant to Article 50a(1) and Article 130a(1) and (2) of the Act, according to the applicable rates specified in the Resolution of the Grudziądz City Council.

5) Keeping by the Contractor for the fees referred to in point 4 separate accounting and financial records, in accordance with applicable regulations in this respect.

6) Keeping records of vehicles accepted into the guarded parking lot, which were picked up by the owners and not collected within the statutory period.

7) Keeping records for vehicles removed from the road pursuant to Article 130a of the Act and vehicles removed pursuant to Article 50a of the Act.

8) Keeping a register of vehicles received and issued containing:

(a) the date and time of acceptance and delivery of the vehicle,

b) the date and number of the permit to collect the vehicle from the guarded car park,

9) Transfer of fees collected on a given day to the Ordering Party's bank account No. 38 1020 5011 0000 9102 0169 6095 within 2 working days from the moment of receipt of the fee for parking the vehicle in the guarded parking lot from the owners of the removed vehicles.

10) Delivery to the Ordering Party as confirmation of the performance of the resulting activities

from the contract, collective lists of vehicles stored and collected for the current settlement period, specifying the fees referred to in paragraph 4 for the service together with a register of vehicles received and issued and with copies of proof of payment –

by the 5th day of the following month.

(11) Adequate safeguarding of funds collected from vehicle owners.

12) Securing information and personal data collected against access by unauthorized persons.

13) Preservation of data to which the Contractor has gained access as part of the contract.

14) Acceptance of full civil and legal liability for parking and storage of vehicles, their parts and other things during the provision of the service.

15) Preparation of a protocol for the transfer of the vehicle to the vehicle dismantling station indicated by the Ordering Party for the entity selected by the Ordering Party to the world
