1. The subject of the order is the purchase of technical support for the SI Emeryt system together with migration works for the Pension and Pension Facility of the Ministry of the Interior and Administration, which includes the following services:

1.1. maintaining SI Pensioner in operational efficiency, including removing errors and failures in system operation,

1.2. ensuring compliance of the SI Emeryt operation with the current legal status in the area of retirement and disability pensions, adapting SI Emeryt to the generally applicable legal provisions specifying all obligations of the pension authority,

1.3. modifying the SI Pensioner in accordance with the needs of the Employer,

1.4. virtualization and SI migration Retirement on the Oracle 12c platform.

1. The subject of the order is the purchase of technical support for the SI Emeryt system together with migration works for the Pension and Pension Institution MSWiA, in accordance with the Description of the subject of the order (OPZ), constituting Annex No. 1 to the ToR.

2. As part of the subject of the contract, referred to in point 1, the following services are included:

2.1. maintaining SI Pensioner in operational efficiency, including removing errors and failures in system operation,

2.2. ensuring compliance of the SI Emeryt operation with the current legal status in the area of retirement and disability pensions, adapting SI Emeryt to the generally applicable legal provisions specifying all obligations of the pension authority,

2.3. modifying the SI Pensioner in accordance with the needs of the Employer,

2.4. virtualization and SI migration Retirement on the Oracle 12c platform.

3. The specification of the IT equipment, software and licenses owned by the Employer for the needs of SI Emeryt are set out in Annex 2 to the OPZ.

4. SI Emeryt is an IT system supporting the proceedings regarding the retirement provision of officers subject to the provisions of the Act of 18.2.1994 on retirement provision of officers of the Police, the Internal Security Agency, the Foreign Intelligence Service, the Military Counterintelligence Service, the Military Intelligence Service, the Central Anti-Corruption Bureau, the Border Guard , The State Protection Service, the State Fire Service, the Customs and Tax Service and the Prison Service and their families (Journal of Laws of 2019, item 288). Currently, SI EMERYT is based on a technological stack, the components of which are described in Annex 2 to the OPZ.

5. In the period from 5.8.2016 to the date of initiation of proceedings, the Awarding Entity made 19 modifications to SI Retirement, and six modifications resulting from changes in legal regulations are planned to be completed by the current contract. The list of modifications is included in Annex 2 to the OPZ.

6. The scope and rules for the performance of the subject of the contract, including the requirements and conditions for the implementation of the contract are also specified in the Contract Template constituting Annex 3 to the ToR.

7. The Employer requires that the Contractor or Subcontractor during the implementation of the subject of the contract employ persons performing activities in the field of accepting reports of errors and failures in the operation of SI Emeryt, on the basis of an employment contract within the meaning of the Act of 26.6.1974 of the Labor Code ( Journal of Laws of 2018, item 917, as amended) and documented this fact by submitting documents described in detail in the Model Contract, constituting Annex 3 to the ToR.

8. The Contractor undertakes to provide the Employer with services that are the subject of the contract, referred to in points 2.1.-2.3. for a period of 36 months from the date of conclusion of the contract, but not earlier than from 5.8.2019.

9. The SI Emeryt virtualization and migration service for the Oracle 12c platform will be implemented in accordance with the framework schedule and scope of activities set out in Annex 1 to the OPZ.
