The subject of the contract is the delivery to the locations indicated by the contracting authority: network switches and their elements, a measurement and network management system and equipment for long-range transmission for the purpose of carrying out works in the project entitled "PIONIER-LAB - National Platform for the Integration of Research Infrastructures with Innovation Ecosystems".

1. The subject of the contract is carried out for the ordering party and the receiving entities listed in the SWZ.

2. Detailed requirements regarding the subject of the contract are an integral part of the description of the subject of the contract and are included in Part IV of the SWZ.

3. The specification of the devices for each of the receiving entities in the scope of each of the tasks of the contract is indicated in Part IV of the SWZ.

4. Locations (places of delivery) of the complete subject of the contract included in a given task along with their assignment to individual receiving entities are indicated in Part IV of the SWZ.

5. The Contractor shall be obliged to provide each of the receiving entities with a quality guarantee and shall be obliged to perform the services resulting therefrom. The warranty requirements are set out in Part III and Part IV of the SWZ.

6. The delivered subject of the order must be brand new, not displayed at exhibitions, complete and technically efficient. The statement "brand new" should be understood as the subject of the order originally packed, not used before the date of delivery, excluding the use necessary to carry out the test of its correct operation after manufacture.

7. The subject of the order must be free from any physical and legal defects and claims of third parties.

8. The subject of the contract supplied must come from the distribution channel of the manufacturer not excluding distribution to the Polish market and ensuring the exercise of warranty rights.

9. The subject of the order must be delivered to individual receiving entities together with user manuals, controllers and any accompanying software necessary for the proper use of the subject of the order (obtaining full functionality indicated in Part IV of the SWZ). Individual receiving entities will not be obliged to pay any additional fees, in particular license fees, and any licenses will be granted as part of the contractor's remuneration, without time and territorial limitation, unless otherwise expressly stated in Part IV of the SWZ. If licenses, codes or other permissions are needed to run and use this software, they must be provided at no additional charge. Codes, licenses, and other permissions must also be provided if they are necessary to run or configure hardware components.

It is not necessary to provide user manuals, controllers and possible accompanying software if it is possible to download them from the respective services; In this case, however, the contractor is obliged to provide passwords, codes, etc. necessary to download.

10. The delivered item of the order intended for power supply from the power grid must be equipped with a sufficient number of power cables to allow it to be connected to standard power outlets, unless otherwise stated in Part IV of the SWZ.

11. The subject matter of the contract offered on the date of the tender may not be foreseen by the manufacturer to be withdrawn from production or sale.

12. The warranty requirements are set out in Parts III and IV of the SWZ.
