The subject of the contract is the supply (purchase) of electricity to Toruńskie Wodociągi Sp. z o.o. in Toruń within the meaning of the Act of 10 April 1997. Energy Law (consolidated text: Journal of Laws of 2022, item 1385, as amended, hereinafter referred to as "PrEnerg") in 2023. Detailed information on the location of individual collection points (consumption, e.g. buildings, facilities), their description and assignment to individual tariff groups, as well as their current capacity and expected electricity consumption during the term of the contract is presented in Annexes No. 1 and No. 2 to the specification of the terms of the contract (SWZ)

The subject of the contract is the supply (purchase) of electricity to Toruńskie Wodociągi Sp. z o.o. in Toruń within the meaning of PrEnerg in the period from 01.01.2023 (provided that the procedure for changing the seller is effectively carried out) to 31.12.2023, with a volume of approximate size: 13 500 000.00 kWh. This order does not cover electricity distribution services. Detailed information on the location of individual collection points (consumption, e.g. buildings, facilities), their description and assignment to individual tariff groups, as well as their current capacity and expected electricity consumption during the term of the contract are presented in Annexes No. 1 and No. 2 to the SWZ. For connection points 1 ÷ 121 listed in Annex 1 to SWZ - the Distribution System Operator (hereinafter referred to as "DSO") is ENERGA OPERATOR S.A., 130 Marynarki Polskiej Street,

80 – 557 Gdansk. For connection points 122 ÷ 126 listed in Annex 1 to SWZ - DSO is POLENERGIA DYSTRYBUCJA Sp. z o.o., Krucza 24/26, 00 – 526 Warsaw. As a result of concluding new contracts for the distribution service or in situations economically justified for the ordering party, some of the parameters listed in the SWZ may change. Such a situation may concern contractual power or tariff (technical reasons), and such a change may be applied only within the tariff groups included in the subject of the contract. The estimated electricity consumption was made with due diligence, however, it is indicative, estimated and related only to the current needs of the ordering party. The Contractor must have concluded and binding contracts, the so-called general distribution agreements, with the above-mentioned local DSOs, on the basis of which it will be able to sell electricity through dso distribution networks to all the contracting authority's facilities indicated in the SWZ. For all PPE, this is another change of seller, and currently the role of the seller of electricity for all connection points listed in Annex 1 to THE SWZ is performed by: PGE Obrót S.A., 8-go Marca 6 Street, 35-959 Rzeszów.
