Services in the maintenance and development of the FARMER System supporting the service of farmers' pension benefits.

1. The subject of the order includes the following services:

1) Designing, providing, operating and managing the Basic Computing Center and the Backup Computing Center, whose infrastructure (servers, arrays, and ICT links, etc.) will be dedicated exclusively to the FARMER Benefits Information System, i.e. intended exclusively for the Ordering Party and for the purposes of performing the order covered by the Agreement, along with ensuring an appropriate level of security and integration with the Integrated IT System KRUS;

2) Carrying out migration to both Computing Centers referred to in point 1) and starting operation in FARMER Computing Centers along with data migration;

3) Provision of services of day-to-day administration and operation of Computing Centers together with FARMER;

4) Performing FARMER Modifications in the scope of the Ordering Party's needs and legal changes, including in particular:

a) conducting analytical, design, programming and testing work,

b) installation and implementation works,

c) preparation of documentation for each FARMER Modification and updating of documentation after the implementation of a given Modification,

d) transfer of proprietary copyrights to the Products, including Modifications, Source Codes and created Documentation,

e) preparing, providing and conducting workshops in the form of e-learning or stationary workshops,

f) performing other works commissioned by the Ordering Party related to the operation and development of FARMER.

5) Provision of FARMER Maintenance and Service Services, ensuring its uninterrupted, trouble-free operation, together with Computing Centers (Primary and Backup) including in particular:

a) providing technical support services, removing detected defects and non-compliance with the law, including software defects and data collected and processed in FARMER;

(b) producing, updating and maintaining the FARMER technical and user documentation library;

c) maintaining ICT environments (ensuring availability and efficiency, updating environments in the field of standard and dedicated software), including production, test and development environments;

d) monitoring changes in legal acts to the extent that they may affect the functioning and safety of FARMER;

e) providing explanations, assistance and consultation to FARMER users;

6) Acceptance for implementation, commissioning and commencement of operation in Computing Centers, the FARMER Version provided by the Ordering Party, which is a product made by third parties;

7) Transfer of the provision of operation and maintenance services to FARMER to a new contractor or the Ordering Party.

2. The Contractor's services must be provided on the basis of an information security management system implemented on the part of the Contractor in accordance with the requirements of the PN-ISO/IEC 27001:2017-06 standard or equivalent. The contractor, throughout the entire period of contract performance, should have a valid PN-ISO/IEC 27001:2017-06 certificate or equivalent, provided that the conditions set out in subchapter IV point 2 of SWZ should be met.

4. Pursuant to Article 121 of the PPL Act, the Contracting Authority reserves the obligation of the Contractor to personally perform the subject of the contract to the extent specified in:

a) Annex 1 to the Agreement – Chapter II, Subsection II.1, stage 1, point 1 and point 2

b) Annex 2 to the Agreement – Subsection 2.1.

5. THE EVIDENCE MEASURES IN QUESTION

The Contractor shall submit together with the offer:

a) solving the task in the form specified in Annex 18 to the SWZ;

b) a certificate of an independent entity dealing with the certification of compliance by the Contractor with certain quality management standards in confirmation of the requirement specified in subsection IV, point 2 of the SWZ;

c) a certification/recertification audit plan, as a result of which the Contractor has obtained the certificate referred to in point (b).
